90 Day Reporting Grace Period Question

As I understand, there is a 7 days late grace period on the date that the 90 day report is due. I am wondering, if you are planning to leave Thailand by airplane within less than 7 days after your 90 day report date is due, if you still need to file the 90 day report at the immigration office before you depart from Thailand? Thank you.

The 7 days after the report date is for doing the report. Leaving the country is not equal to doing a report.

It would not be a problem leaving the without doing the report since they do not check for them when you leave the country. 

The only problem could be your local office noticing you did not do a report before leaving the country. The could fine you 2000 baht for not doing the report.

No you do not need to report your address for the next 90 day period because you are leaving the country.

 

There is no ‘grace period’ as such. A report is not considered late unless made after day 97, and a fine can only be charged if reporting after day 97. The need to report ends as soon as you leave the country, and as you won’t be staying after day 97 a report is never late (overdue) or required.

 

No fine becomes due if leaving within 97 days, and Immigration cannot retrospective fine you at any point in the future.

 

This question has been asked many times in the past and those that ask immigration directly are told there is no need to report.

I then checked with them whether I needed to do it.

They gave me a clear not required within the 7 day grace period.

So leaving after 90 days but before 98 days without reporting is okay.

This was Muang Chiang Rai Immigration.

Thank you both for your good replies. It is my understanding that whenever you leave the country it resets the 90 day clock upon reentry. So pretty much clear now.

 

But just want to be sure my local office wont fine me the 2,000 Baht anytime in the future after I return to Thailand, assuming I leave within the 97 days? Also hope that I wont have an issues at the airport for not reporting within 90 days if I leave on day 95?

As Ubonjoe says, you'll have no issues at the airport as 90 day reports are nothing to do with them. The chances of the non-report being picked up when you do your first 90 day report, 90 days after you return to Thailand are minimal. Probably worth the risk.

Thanks. It sounds like if you leave within the 97 days though that you aren't obliged to file. Since they give you 97 days to either leave within that time or file, and @elviajeros said the additional 7 days isn't considered a grace period, but a part of the total time period that you have until filing your next report, then leaving before the 97th day should not trigger a late penalty it seems.

There is conflicting opinion on this Forum about that. I would take Ubonjoe's advice.
