The Constitutional Court cited the following criteria previously used in 2000 (possibly during challenges for the nations first Senate elections under the Thaksin regime?), to determine if someone is or has been a state official.

 

1 - appointed and/or elected by law;

2 - having the authority and duty to enforce laws and perform routine functions;

3 - being under the command or supervision of the state;

4 - and receiving a regular wage or salary.

 

So it is clear that the PM, as a usurper of power, clearly doesn't fit these categories.

 

So, moving right along, how can someone who very publicly committed an illegal, criminal act of overthrowing a seated government by military coup become an acceptable choice for Thai PM?

 

That protection was written into the frequently ass-raped Thai Constitution by the previous military C-i-C usurper-come-MP when he was reviewing his life after military service.

Wasn't Prayut elected by the NLA to become PM - Head of Government?

Did not PM Prayut visit POTUS Trump in Washington D.C. as Head of Government?

Certainly Prayut didn't go to D.C. as Chief of the NCPO.

I think it was expected by all because he has the military weapons in his control and his appointments on the court. That seems to be the only qualifications required to be a Prime Minister.

agree … but Thailand is much better now so far as security, economic stability and a government in control.

Before it was protests, lawlessness, and mayhem, at least now the country has moved on/

Assuming this statement is being serious, it depends what time frame you are looking at. Thailand has never had much of a security issue so bit of a moot point. How would you argue that the country has economic stability when the disparity in wealth is so enormous. Government in control, hmmm, in control of what exactly. Thailand may have once had a chance to move on but I fear that boat may have sailed a while ago.

Guess security has certainly improved, especially by treating long term expats as potential criminals and terrorists by reporting your movements evertime you go for a leak and reporting again when said leak is finished - that's really moving on.

You are living in a fantasy. You are confused. Thailand has become a military state and it’s people have lost the democracy and their liberty, and for what? So the corrupt can continue to rob the nation of its treasure and  it’s future? 

The protests, lawlessness and mayhem you speak of, were arranged by the man you champion, as a pretext for seizing power. Thailand suffers needlessly. 

You need therapy.

Come in and deliberately cause trouble. Get a reaction from the other side and then violently crack down on the people you instigated the trouble with. Then you tell the country you're the saviours.
