Hi,

 

I’m sure this question has been asked hundreds of times but I have seen a lot of conflicting information online and also been told things that have been inaccurate.

 

Has anyone recently been through the process of acquiring a non imm B visa & WP in Thailand? If so could you explain the process.

 

I have been told it takes a month for the non imm B visa and WP to be returned. Now the school I’m due to work for has said that I can work whilst the process is being completed. Is this in fact true? I wouldn’t imagine so.

Thanks for the reply. I wouldn’t take the risk. I must say it has been quite shocking that schools are so willing to encourage their staff to skirt the law.

No, actually it is legal and theres no problem for you and for the work and no risk at all. 

 

1) all the paper work from the school should take 2 hours to print it out. Lets say school director sign it... what... another 2 hours? so totally 4 hours. Thai ppl like to take it slow. Probably your paper work will take 2 weeks to print it out (because your not important for them but other paper work is more important) and the signature of the director will take another 1-2 weeks (again same reason). 

2) lets say they are preparing your paper work and its in the process.. This means you already signed a contract and your being putting in to the system. Which means your already employed which means your totally free to work, no risks at all. If someone comes and ask your WP your school can explain all. 

3) WP takes normally 3 days. Extending your visa is 15 mins.

4) to get your 2 year teacher letter... i think around 15 days.

5) certify your diploma from your embassy.. i would say another 10 days

6) translation of your diploma into thai... 5-6 hours

it is totally legal and no risks. Because he is already hired and the paper work is in process. If someone asks about his WP school will explain everything. And they will tell to school to hurry up, thats all. You would be right with your comment only IF the post owner works without signing a contract or by himself without any paper work. But in this case hes hired by a school. And all immigration all police knows this. So there is no risk or nothing illegal.

 

if you teach at a university it takes 3 months to get all paper work in your first year. And nothing happens. 

 

To the post owner: your totally safe and it is legal. no worries just go to your work. You only need to worry after 2-3 months. that means somethings wrong.

It is NOT legal, you are not allowed to work while something is in process. Who says that it will be given. Total BS answer.

You are wrong again. First of all you can work while your papers in process. If you cannot get your WP for some reason then school will tell you goodbye thats it.

 

All the paper work is ready which means all the paper work copies are at the school and when they apply to labor office, labor office gives them a paper which is telling that your work is in process and you can continue your work meanwhile.

 

But as i mentioned before if you cannot get your WP in 2 months, theres something wrong and you should stop working and find out the reason. Meanwhile its totally legal to work.

 

theres no teacher start working with all WP and non-b ready. this not europe or usa

That people do it doesn't make it LEGAL. According to the law you can't work until you HAVE your work permit. Don't spread things which aren't true. You know what happens a lot but have no clue about the labor law.

well you made your point and i made my point.. seems no need to talk about this any longer.

There is not even 1 teacher punished because of teaching 1 month or 2, while all paper work in process. Even the labor office says the same, you can go to your work. But you said he will be taking the biggest risk which is we all know not true. Just because of your post he might miss his working chance. And i still believe it is legal to work while your papers are in process stage due to your work duties and responsibilities.

sorry for the edit but its a update maybe: I just asked my friend working in the immigration. He told me that yes it is considered as illegal to work without a work permit. Although in slow progress conditions, they tolerate till WP and other things be ready due to work duties and responsibilities. He said its totally understandable if an officer goes to school to check WP and sees hes not done yet, if he sees the all paper work, he would do nothing at all. Thats what my friend working at the immigration said.

Your friend in immigration deals with immigration, the labour office deals with work permits and labour law. You could have asked a traffic cop too.
