Section 1382. Where a person has, for an uninterrupted period of ten years in case of an immovable, or five years in case of a movable, peacefully and openly possessed a property belonging to another, with the intention to be its owner, he acquires the ownership of it.

 

Does this mean, one can simply maintain a fence around a parcel of land for 10 years, to take ownership of it...  Must one update the land office at any point ?

For ownership to be transferred, the Land Department must amend the land title(s) to reflect the position of the new border(s)... I understand that this is done by a judge via court order, therefore the individual trying to take the land must satify the judge that all necessary criteria have met.

 

As the person who stands to benefit is in most cases the individual trying to take over the land, therefore it is with them to pay the court fees to have the land title papers amended.

 

Aside from the judge requesting the land office to change the borders, the rest are my assumptions.
