Hi All,

 

After being denied entry some months ago at DM for coming in and out too many times on a tourist visa I had to go back to the UK and get a none O visa as my son is in school here, I am divorced from my ex and take care of my lad.

 

I might get the terminology wrong on this but my visa finished in January, just wondering what are my options in regards to reneweing it or extending?

 

I got a wierd email from the consulate when I asked them see:

Have you visited or spoken to anyone at the British Embassy in Bangkok? If not we advise you to do so.
Also you will see we have attached scans of the documents you provided when you applied for your ‘O’ visa on 04 October 2019 which you may find useful.

It just isn't very clear, I do not want to wait till January and be in a pickle, just wondering if any of you guys know what I should do?

He has dual nationality.

 

2.18 In the case of being a family member of a Thai national (applicable only to parents, spouse, children, adopted children, or spouse’s children): 

Each permission shall be granted for no more than one year. 

(1) The alien must have been granted a non-immigrant visa (NON-IM). 

(2) The alien must have proof of relationship. 

(3) In the case of spouse, the relationship must be de jure and de facto: or 

(4) In the case of children, adopted children, or spouse's children, said children, adopted children, or spouse's children must not be married, must live with the alien as part of the family, and must not be over 20 years of age except in case of the person hereof is of illness or disability and cannot live without support of father or mother: or

(5) In the case of parents, the father or mother must maintain an average annual income of no less than Baht 40,000 per month throughout the year or must have deposited funds of no less than Baht 400,000 to cover expenses for one year. 

In case the father of mother requests to be under maintenance of children, the age of father or mother must be 50 years of age or over.

You can apply for an extension based upon being the parent of a Thai if you can meet the financial requirements.

It seems you were married to your child's mother which eliminates a problem people have a due to them not being the legal parent of their child.

Thanks for the reply,

 

I am from Hull in the UK so it was quite easy to do back home, I did not need to show any proof of income etc, I had to show his school certificate, birth cert and a few other docs but nothing related to money. 

 

So are we saying if I choose to stay in Thailand and get an extension I would need proof of funds etc? I get paid by a UK company you see and it can be quite awkward showing a steady income although I do have one, it kinds of depends on the projects where I work for gets in, 

 

It sounds like I am probably best flying back to the UK and getting another one? seems alot of hassle just to get a none O when I have already been granted one, I assume I cannot just extend for 30 days or 60?

You can get single entry non-o visa based upon being the parent of a Thai at some nearby embassies and consulates.

You can apply for 60 day extension to visit your child for any entry to the country.

Tough spot to be in.

 

Might pay to sit down with a legal guru to properly work out a long term approach. You at least need multi entry for starters. Then all finances with travel costs, schooling etc locking down 400k thb just for fun doesn't seem realistic.

 

There are some good quiet helpful immigration officers that may come up with best workable solution.

 

Hope you still get on with the ex. I never have...

The 400k baht is not locked. It only has to be in the account on the date of application for an extension of stay based upon being the parent of Thai and then possibley 30 days after while the application is under consideration.

Certainly no reason to use a lawyer.
