At this time you need more than than their birth certificate to apply for a certificate of entry at the Thai embassy where you are located and being the parent of a Thai has not fully been confirmed yet.

You would also need a non-o visa to enter.

Is good if you make the papers at the Amphoe that you're the legitimate father next time

Legitimization of his parenthood may not be required to do the application.

He could of also been married to his child's mother when their child was born.

I am in a similar situation, was married, now divorced, have 1 child in Thailand, I am named on the birth certificate which I have a copy in Thai and an English translation.  My child has just got their first Thai National ID, the name was so wrong, so I sent the Aunty back with the correct English Translation version, they corrected it no problem.   I'm hoping they open travel to fathers of Thai children soon, normally I just go an a 30 day exemption but that route may not be available for a while.
