Biden blasts Trump's plan to push for Supreme Court nominee before election

14 presidents appointed 21 justices during presidential election years. 6 "lame duck" presidents appointed justices after their successors had been elected, but before they took office.

 

President Barack Obama said, “Your job doesn’t stop until you are voted out or until your term expires.” Which isn't 100% true. The sitting president's job stops when his/her succesor is sworn in.

 

So, Trump could nominate someone now and the Senate could take almost 4 months to decide whether or not to accept his nominee. Trump could wait until after the election and still nominate someone... even if he lost the election.

 

The critical issue is whether or not the Republicans can maintain control of the Senate. If so, they could decline Biden's nominees should he win, if deemed too leftist/radical.

And in the last 100 years only three of those nominations were confirmed by the Senate during a Presidential election year, all three in January or February.
