I work here in Thailand, BOI work permit, lived and worked in Thailand since 1996. I'm 41, my mom is going to be 61 in November. She has no income in the US, no job, no assets. I intend to bring her to live in Thailand near me. Which visa can I obtain for her and what is the cost of doing that? If I apply for permanent residence and I am accepted, will it have any impact on her status if she is granted a visa due to my work permit?

I've been working in Thailand as a teacher since 2002. I was able to let my mother stay with me and my wife for the past three years. She comes to Thailand for 9-10 months and a few months she's at home. She doesn't want to stay for a year. She's now 80 years old.

It isn't a hazzle at all. You need all the papers similar as for extending a visa + a to-date letter from your employer stating that you're still working with employer. One very important statement from your home country is needed and that is a birth certificate that shows that she's your mother and you are her son/daughter. That's all. All the papers are send to Immigration in Bangkok (if you do it upcountry) and your mother gets every month a 30 days (under consideration) extension untill an extention synchronised with your visa is granted. Any statement related to her income wasn't required.

Because of 7.18 and 7.19 of the National Police Office Order

No. 606/2006, she would be allowed if you have an extension of stay or if you are a resident.

Reason of Necessary

7.18 In case of being a member of family of the person who has the residence in Thailand (Only for the father, mother, marriage couple, ordinary child, adopted child, or a child of the marriage couple)

Consideration Criterions

Each time of permission shall be granted for a period not exceeding 1 year.

(1) Foreigner obtains VISA for the temporary stay and

(2) There is any proof of the relationship and,

(3) Incase of the marriage couple, the parties required to have both practical and legal relationship or,

(4) In case of the ordinary child, adopted child, child of the marriage couple, these person need to be single/never married and has never lived as a part of the family before, and shall not be older than 20 years old, or

(5) In case of Father or Mother, the said father or mother shall be not younger than 50 years old.

List of Required Documents

1. Application Form

2. Copy of the passport of the applicant

3. Copy of the proof of relationship such as marriage evidences, birth certificate, certificate of child adoption registration, copy of census registration, certificate of adopted child adoption registration, or other papers issued by the related official organization or government agencies.

4. Copy of the certificate of permanent residence and copy of the ID Card of the foreigner who has the permanent residence in Thailand.

This whole thing is news to me. My mom will apply for a retirement visa over the next months. Does the above mean she could just get a visa based on my marriage visa as a dependant? I'm married here to my thai wife and just got my 2nd annual extension...

Yeah, just wasn't sure if you needed "permanent residence" to apply for it or if you could do it on an annual marriage visa too. And would she need to be on an "O" visa? Or tourist visa? Or doesn't matter..?

Remarks

The Applicant must sign every page of application.

The Company Authority must sign to certify all documents stamped with the company seal.

The visa applicant must arrange the documents in proper order and must prepare the originals as proof.

I will go to change my Mom's visa from a tourist to a non-immigrant "O" either tomorrow or Monday. I assume I won't need all the company documents if she's applying based on my annual extension (marriage visa)? All the other documents are in order, such as birth certificate (proof of relationship) certified by the embassy, etc.

I'm in a similar situation to Rainman. I'd like to get my 76 year old dad over, he's got the requisite pension (with a top up in the bank) but if I can get him in with no financials so much the better.

Unfortunately there is a problem, he's not my biological father just a step father, I was never adopted in any way shape or form when he married my mum 30 odd years ago.

So do these rules recognise step parents?

Well, I went to Immigration in Suan Phlu today with all the documentation and they told me that it's not possible. It would be possible if I had a work permit here and wasn't married, but since I am married to a Thai wife, I cannot apply for a dependent visa for my mother. Doesn't make sense to me? Maybe the Immigration officer didn't have a clue what they're talking about?
