Widow(er) of US citizen enter to USA advise please

Recommended Posts

My sister's been marriage to US citizen 10 years ago and had a child together, Her husband took the child with him as he want the child to get education in the State. she is now 9 years old and live in USA, with visa restriction my sister she's refuse to entry  USA they then living life separately but remain marriage. My brother in law recently had lunge covid19  and passed away few day ago and left families in the dark. The child is now been look after by grand parents, grandpa had hearing issue and grand me had sight issue ( partial blind) but they are not register disable. when my brother in law still alive he's main man look after everyone. now he's gone which left the young child no direction.

I myself ( aunt) live in UK and i am UK citizen. During Covid travel restriction had made everything complicated.

My sister whom now in Thailand now want to go to get her child which she want to bring her back to Thailand but grandparents who's now lost their son but granddaughter is now what they have got left. I personally don't think the grandparents is capable to look the child and I clearly understand that if I step in it could cause complication. I live alone and had my own business and own home. Ideally I would like to take care my niece.

My sister is now looking to get Visa to USA and look after the families during difficult time but she's no idea where to start or where to begin. she's just lost her husband and child is been neglected during sad time.

she's very mature for her age and very very sad child. my hearth is really broken to her what's she been through at the moment.

My sister is now working from home and she could working remotely online as she did in Thailand and it's not different if she need to from home in abroad, the company she's working for willing to remain to hire her if she have to work from other part of the world.

My question are how can my sister go to USA to look after the child or bring the child back if necessary?

Can I go to USA and bring the child back to thailand for her mum? ( I have an ESTA)

can I adopted the child? (which my sister happy for me to do so)

Can my sister go to USA and look after the families and HOW?

I really hope someone here could give me the advise

SJ

Your sister needs to contact an immigration attorney.

There are many questions, like what is the child's passport, is your sister listed as the mother, what were the custody arrangements when her father took her to the USA, will the grandparents agree to her plans (or will they object), does the child want to return to Thailand, etc.

As an American I did not have experience with UK visitor Visas.

But the main goal and it's actually the law in US embassy is to ensure they won't want to stay.

Her job lie was really a mistake.  This is these people's job.  Don't you think they can sniff fraud?   But also massage is a perfect occupation to be able to find quick work in most countries.  Legitimate massage or the + kind.    How long have you been apart?   You may have some savings and disability income.  Sorry to hear that.  But your not exactly a big income earner and could use a live in nurse it would appear.  Massage skills a plus.

I think you have a steep hill to climb with this woman.

The child doesn't want to come to Thailand. she is worry about her grandparents ???? bless her heart she's only 9.

the agreement for the father to take care of child because he had to go back as parents one become deft and the other become blind plus grandparents want to meet the child at that time and they decided to live apart but remain in relationship, they spokes most day on social media. The child is American citizen had American passport

Check "integrity legal", an immigration law firm in Thailand and the US. You can find them on youtube. They offer a free consultation.  They can get you pointed in the right direction i think.

thank you, will have a look
