NCB warns public that you can't grow marijuana for recreational use despite drug being left off new codes

The spokesman for the Narcotics Control Board has warned the Thai public that it is still illegal to grow marijuana for recreational drug use. 

 

Health minister Anutin Charnvirakul rose to power on a platform of legalization - but this has fallen well short of public expectations. 

 

Piyasiri Wattavarankul's comments come after the drug's name was left off new codes announced on December 9th 2021, reported Thai Rath

 

Marijuana was previously mentioned by name as a Class 5 narcotic. 

 

Now the new code merely says that "Class 5 is a drug not mentioned in Classes 1-4".

 

These are hard drugs like coke and heroin and others.

 

The only ganja that can be grown are plants that contain minimal amounts of the substance that makes you high, THC.

 

Only 0.2 is allowed - pointless as a narcotic. 

 

Even then permission must be sought with regional health authorities and growers must register in community schemes to supply the CBD oil for medicinal and research use. 

 

The leaves - that contain no THC - have become a fad as a food or food decoration over the last year.

 

Health minister and DPM Anutin's  Bhumjaithai party rose to join government power on a manifesto of allowing each household to grow six plants.

 

Candidate billboards featuring the ganja leaf at a general election astounded Thais used to draconian laws in the kingdom.

 

The reality of what some people had hoped in the growing of the plant has been very different to the political promises put out by Anutin as construed by the public, notes ASEAN NOW.

 

He said it would be an economic boon for householders. Critics are now saying that it is just a law change that favors big business and the elite. 

 

True legalization - especially for recreational users - remains completely out of reach.

 

The only certainty if caught with ganja is heavy fines or even jail terms.

Thai logic at it's best , why would 5 be mentioned in something 1 - 4 .

I knew when it was said it was been legalized and you could grow 4

plants, but not let them flower , there would be a BUT.

Plenty cafe's and coffee shops are making profit on this.  Boiling leaves in water and telling the customers they are getting CBD.  Impossible

I don't think you can grow tobacco or brew alcohol either, both legal drugs.

Both the relevant statutes, Narcotics Act 2522 (1979) and the Psychotropic Substances Act 2518 (1975) cover production, distribution and use of drugs as defined (cat. 1 -5)  in those acts.

 

Special exemptions have been made for the production of Cannabis, hemp, kratom. With further delineations within the cannabis designation. And some forms of cannabis (THC content less than 0.2%) and kratom can be consumed.

 

Net net you can't grow or use cannabis without government approval and oversight.

... depends on local regulation, 25 years ago the tobacco-monopolised Austria for example allowed 5 tobacco plants per person without declaration/taxation, don't know if that changed meanwhile. 

 

Producing high proof alc - the 'burned (distilled) and double burned Schnapps' - is controlled by checking on the declared distilling equipment, I believe there's just a couple litres you can (legally, cough-cough) produce out of your garden before getting massively taxed for it.

From what I've seen and heard it slows you down to drive like an old woman. Which has got to be safer than driving at high speed as they often do here.

Nearly all Cannabis strains contain CBD, most of them in a very low percentage. It has not to be extracted for use.

Last weekend we went to Singburi to see the Caladium market they have on Sunday.  There was one vendor that had marijuana plants for sale.  They were about 2 feet tall.

Sad but true.  Unless the police force modernized, had stricter laws, far better enforcement and was able to conduct roadside drug testing alongside breath testing, then fully legalizing cannabis will only cause more deaths and carnage from irresponsible people.  

Drug driving is a big issue already.
