Obtaining Citizenship Without Pr

according to the immigration act it is permitted to apply for citizenship after five years residency in Thailand even if you are not a permanent resident. There is a limit of 100 such grantings per year. At least this is what I have read.

When I attempt to apply the officers tell me I must first be a permanent resident for five years, some say seven years, some even said twelve.

does anyone actually know what is the law, where to find an officer who knows the law, and how to proceed?

My particulars: seven years full time residence, business owner, pay lots of taxes every year, married to Thai national five years, children.

Who wants to wait another half decade just to apply? I dont

any help out there?

the officers know the law, and they are correct (assuming you are male).

The only way to get citizenship without PR is to be a foreign woman married to a Thai male.

point 4 on page 2 is the relevant passage. For the purposes of interpretation, this means PR.

Re-read the entire thread. Most people felt it highly unlikely. Good luck to you if you can, but unless you are friends with Sonthi, it is most likely impossible.

I think this means you need to be on a blue house certificate for 5 years and thats only possible if your a PR holder if your a male.

Being here on any kind of Visa does not count as being permanent resident, get your PR ASAP and not lose any more time is my advise , you could have been 1 year away from a Thai Citizenship if you done that after your first 3 years here.

I wish you good luck but I fear there are no shortcuts to become a Thai Citizen...

There is no question - unless you are a foreign woman married to a Thai man, you cannot apply for Thai ciizenship without PR. I applied last year and am 100% certain. Here are the relevant intermal Ministry of Interior regulations relating to the qualificatons and documents to be submitted. Paragraph 4 makes it very clear that you need PR (Blue Book), Alien Book (Red) or your name in a blue tabian baan for not less than 5 years continously before your aplication will be accepted the Special Branch. Trust me, if you do not have PR your application will not be accepted. I tried to submit my appliction after having PR for 4 years and 9 months and the Special Branch told me to come back again in another 3 months. I am very familiar with the process, having just completed it, and am happy to answer any questions you may have. By the way - immigration officers know little about the process and are not a reliable source of information. Citizenship is not an immigration matter, it is a Special Branch(Police) and Interior Ministry matter.

คำแนะนำการยื่นขอแปลงสัญชาติเป็นไทย จากแนวทางประกอบการพิจารณาในการขอแปลงสัญชาติเป็นไทย ซึ่งรัฐมนตรีว่าการกระทรวงมหาดไทย ได้ให้ความเห็นชอบแล้วเมื่อวันที่ 9 กรกฎาคม 2544 ได้กำหนดคุณสมบัติของผู้ยื่นคำขอแปลงสัญชาติเป็นไทยไว้ ดังนี้

1. บรรลุนิติภาวะแล้วตามกฏหมายไทยและกฏหมายที่บุคคลนั้นมีสัญชาติ

2. มีความประพฤติดี โดยจะต้องผ่านการตรวจสอบประวัติอาชญากรรม ตรวจสอบพฤติการณ์ทางด้านการเมือง, ยาเสพติด, ความมั่นคงของประเทศ และหมายจับต่างประเทศ

3. มีอาชีพเป็นหลักฐาน (ต้องมีหนังสือรับรองการประกอบอาชีพจากกองแรงงานคนต่างด้าว หรือแรงงานจังหวัด และต้องมีรายได้ไม่ต่ำกว่าเกณฑ์ที่กำหนด ดังนี้

3.1 กรณีเข้ามาเพื่อทำงานต้องมีรายได้ไม่ต่ำกว่าเดือนละ 80,000 บาท โดยมีหนังสือรับรองรายได้จากบริษัท หรือนายจ้างที่ทำงานอยู่ หรือเสียภาษีเงินได้บุคคลธรรมดาในปีที่ยื่นคำขอแปลงสัญชาติตั้งต่ 100,000 บาทขึ้นไป และมีหลักฐานการเสียภาษีมาแล้วไม่น้อยกว่า 3ปี

3.2 กรณีอยู่ในราชอาณาจักรไทยเพื่อเหตุผลทางด้านมนุษยธรรม เช่น สมรสกับบุคคลที่มีสัญชาตไทย หรือ มีบุตรเกิดในประเทศไทย หรือจบการศึกษาในระดับอุดมศึกษาภายในประเทศไทย จะต้องมีรายได้ไม่ต่ำกว่าเดือนละ 30,000 บาท และมีหลักฐานการเสียภาษีมาแล้วไม่น้อยกว่า 3ปี

4. มีภูมิลำเนาในราชอาณาจักรไทยต่อเนื่องมาจนถึงวันที่ยื่นคำขอแปลงสัญชาติเป็นไทยไม่น้อยกว่า 5 ปี โดยนับจากได้รับใบสำคัญถิ่นที่อยู่หรือใบสำคัญประจำตัวคนต่างด้าว หรือมีหลักฐานทางทะเบียนราษฎร์ที่ยืนยันได้ว่ามีภูมิละเนาต่อเนื่องในราชอาณาจักรไทยมาแล้วไม่น้อยกว่า 5 ปี

5. มีความรู้ภาษาไทยตามที่กำหนดในกฎกระทรวง (พูด และฟังภาษาไทยได้เข้าใจ) และจะต้องสามารถร้องเพลงชาติไทยและเพลงสรรเสริญพระบารมีได้และจะต้องผ่านการสัมภาษณ์จาก

5.1 กรณีผู้ยื่นคำขอมีภูมิลำเนาอยู่ในเขตกรุงเทพฯ ให้ผ่านการสัมภาษณ์จากคณะทำงานพิจารณากลั่นกรองคำขอแปลงสัญชาติเป็นไทย

5.2 กรณีผู้ยื่นคำขอมีภูมิละเนาอยู่ในต่างจังหวัด ให้ผ่านการสัมภาษณ์จากคณะกรรมการระดับจังหวัด ซึ่งผู้ว่าราชการจังหวัด หรือรองผู้ว่าราชการจังหวัดที่ได้รับมอบหมายเป็นประธาน หัวหน้าส่วนราชการที่เกี่ยวข้อง และผู้บังคับการตำรวจภูธรจังหวัดเป็นเลขานุการ

ผู้ยื่นคำขอจะต้องผ่านเกณฑ์การให้คะแนนตามภาคผนวก ข. รวมกันแล้วไม่ต่ำกว่า 50 คะแนน จึงจะได้รับการพิจารณา

เมื่อผู้ยื่นคำขอได้รับอนุญาตให้แปลงสัญชาติเป็นไทยแล้ว กระทรวงมหาดไทยจะแจ้งกระทรวงการต่างประเทศดำเนินการแจ้งไปยังประเทศของผู้ยื่นคำขอเกี่ยวกับการได้สัญชาติไทยดังกล่าว

หลักฐานประกอบการยื่นคำขอแปลงสัญชาติเป็นไทย

ใบสำคัญประจำตัวคนต่างด้าว พร้อมสำเนา 2 ชุด

ใบสำคัญถิ่นที่อยู่ พร้อมสำเนา 2 ชุด

ใบอนุญาตทำงาน พร้อมสำเนา 2 ชุด

รูปถ่าย ขนาด 2* 2 นิ้วครึ่ง จำนวน 12 รูป หน้าตรงไม่สวมหมวก (ชายแต่งชุดสากลผูกเนคไทใส่สูท หรือชุดพระราชทาน หญิงแต่งกายสุภาพ)

สำเนาทะเบียนบ้านทั้งครอบครัว (มีชื่อผู้ยื่นคำขอฯ คู่สมรสและบุตรทุกคน) พร้อมสำเนา 1 ชุด

หลักฐานการสมรส พร้อมสำเนา 1 ชุด (ถ้ามีภรรยาสัญชาติไทยต้องจดทะเบียนสมรสก่อนยื่นคำขอฯ) ในกรณีที่บุตรสาวสมรถแล้ว ให้ถ่ายสำเนาหลักฐานการสมรสของบุตรมาด้วย จำนวน 1 ชุด

หนังสือรับรองยอดเงินฝากจากธนาคาร หรือสมุดเงินฝากธนาคาร พร้อมสำเนา 1 ชุด (ควรมีเงินฝากไม่น้อยกว่า 50,000 บาท)

หลักฐานการบริจาก หรือใบอนุโมทนาบัตรที่เคยบริจากเงินบำรุงการกุศลสาธารณประโยชน์รวบรวมให้มากๆ (ไม่น้อยกว่า 5,000 บาท)

หลักฐานการเสียภาษีเงินได้บุคคลธรรมดา ภ.ง.ด. 90, 94 หรือ ภ.ง.ด. 91 (ใบเสร็จรับเงินและแบบแสดงรายการการเสียภาษีเงินได้) ย้อนหลัง 3 ปี พร้อมสำเนา 1 ชุด

หลักฐานของบริษัท ห้างร้าน นิติบุคคล เช่น หนังสือรับรองการจดทะเบียน ทะเบียนการค้า ใบสำคัญแสดงการจดทะเบียนบริษัทจำกัด ทะเบียนภาษีมูลค่าเพิ่ม บัญชีรายชื่อผู้ถือหุ้น และอื่นๆ ถ่ายสำเนา 1 ชุด

หลักฐานการเสียภาษีเงินได้บุคคลธรรมดา ภ.ง.ด. 50, 51 (ใบเสร็จรับเงินและแบบแสดงรายการการเสียภาษีเงินได้) ย้อนหลัง 3 ปี พร้อมสำเนา 1 ชุด

ถ้าเป็นลูกจ้างหรือพนักงาน ให้บริษัท ห้างร้าน นิติบุคคล ออกหนังสือรับรองตำแหน่งหน้าที่ และรายได้ที่ได้รับในแต่ละเดือน (ผู้ลงชื่อในหนังสือรับรอง ต้องเป็นผู้มีอำนาจลงรฃนามผูกพันบริษัท และประทับตราเป็นสำคัญ) บัตรประจำตัวประชาชน หรือใบสำคัญประจำตัวคนต่างด้าว/ใบสำคัญถิ่นที่อยู่ หรือหนังสือเดินทางของคู่สมรส แล้วแต่กรณี หลักฐานการเปลี่ยนชื่อ - นามสกุล (ถ้ามี) พร้อมสำเนา 1 ชุด

สูติบัตร บัตรประจำตัวประชาชน หรือใบสำคัญประจำตัวคนต่างด้าว/ใบสำคัญถิ่นที่อยู่ หรือหนังสือเดินทางของบุตร แล้วแต่กรณี หลักฐานการเปลี่ยนชื่อ - นามสกุล (ถ้ามี) พร้อมสำเนา 1 ชุด

หลักฐานการศึกษาของผู้ยื่นคำขอฯ เช่น วุฒิบัตร ปริญญาบัตร หรือประกาศนียบัตร พร้อมสำเนา 1 ชุด

หลักฐานการศึกษาของบุตรทุกคน เช่น หนังสือรับรองจากโรงเรียน วุฒิบัตร ปริญญาบัตร หรือประกาศนียบัตร พร้อมสำเนา 1 ชุด

I cannot find that in the Immigration Act. Can you be more specific? Which section of the Act?

The applicable law is Thailand’s Nationality Act, Sections 10 to 12. Note in particular Section 12 and the reference to Ministerial Regulations:

Section 12. Any person being desirous of applying for naturalisation as a Thai, shall file an application with the competent official according to the form and in the manner prescribed in the Ministerial Regulations.
