Daily News Thai Caption: Not over the limit

 

Daily News reported that the tycoon behind the wheel of a Bentley that crashed on the Bangkok expressway injuring many people at the weekend was not over the DUI limit.

 

The media citing one of their sources said he had a reading under 20 mg.

 

Forensics were still studying the speed of the Bentley. The investigation into what happened is still active including toxicology tests.

 

Further news was expected from the met police in due course.

Sometimes I feel we shouldn't be so hard on the police officers who somehow don't find enough evidence to prosecute rich Thai people.

 

Imagine you are a Thai police officer and you have hope to have this wonderful career in your future. And then you have to investigate the possible crime of a rich guy. Then possibly the question goes through your mind if you will have such a wonderful career if you find evidence or if maybe your career will be a lot better if you somehow don't find such evidence.

Two-door coupé Bentleys aren't exactly limos that would normally have a driver.

I'm not condoning his driving but why shouldn't he walk free with a few points, a fine and maybe a compensation order?   He wasn't over-the-limit drunk, didn't kill anyone and his charge was only reckless driving causing injury.   Is there a mandatory jail sentence for that traffic offence?

No, they say that if you have a Roller you get a driver, if a Bentley, you drive it yourself.

The blood test might have be taken late enough to get rid of anything over the limit...:whistling:

I used to be a driver for a two door Aston Martin DB6 Mk II. The owner sat next to me as he liked been driven very fast…..90mph country roads in England. And if in a hurry 120mph on the motorway. This was in the early 1970’s, I was back in England in early 80’s and those speeds were no longer possible on the country roads because of a huge increase in the amount of vehicles on the road. Some might consider what I did dangerous driving, but I was very good, and the car was superb as a handmade car should be. In two years I only got stopped twice by the police. The first guy let me go as I was driving alone and he assumed I owned the car. The second doing 80mph on the motorway when I had the flu and got a ticket. The car was so stable with SelectaRide, among other goodies. One day wandering around at the Newport Pagnell factory I noticed a convertible Aston off in a corner, and asked what the story was? It’s Prince Charles’s car….we just dump it in the corner for a few months before we bother to touch it.

He still has that same car fifty years later. He let William drive it after his wedding with his wife, but he forgot to release the handbrake for his drive from the Cathedral…..back to the factory!

Its a forum designed for discussion... We can speculate...  You seem to think you are taking part in a legal discussion and we can only discuss undeniable proven fact... 

 

...  Not being lawyers and not being held to account for our comments we have the freedom to discuss the probable.... 

 

In this case - given the environment we face ourselves in; from extremely common DUI, to the obviously lack of regard for law shown by the wealthy, to the ease with which they are not held accountable to the laws and to the utter ineffectiveness of law enforcement in Thailand we can all very easily draw the ‘assumption’ that this guy was ‘quite pished up and used his influence to circumnavigate formalities to avoid further legal action’....  its par for the course here.

While the accident occurred at 12.35 am on Sunday it wasn't until 5 am before the Bentley driver was tested.

 

He had a reading of under 20mgs five hours after the crash. The body metabolises alcohol at around 15-20 mgs/hour.

So add maybe 75-100mgs ( lets  do him a favour and call it  60mgs) to his 20mgs result, and that puts it  at around 80mgs.

 

The limit in Thailand is I believe 50mgs.

Agreed...  Basic BAC calculators show that to have had a BAC of 20mg/100ml (i.e. 0.02%) after 5 hours he needs to have had 8 standard shots of spirits - which at the time would have placed him at 100mg/100ml (0.01%) 5 hrs earlier - Double the legal limit to drive.

I don’t think he claimed a heart condition... didn’t he claim 'chest pains'... (could have been from the seatbelt or air-bag).

He wasn’t over the drink driving limit by the time he was tested. 

 

Its obvious to any of us that the BAC 5 hours later is a lot less than it would have been at the time of the accident. The report also states less than 20mg, but doesn't state exactly what his BAC was. 

 

It could be argued by an expert witness (i.e. a Doctor) that his BAC 5 hours after the accident proves he was DUI.

 

You seem to want absolute black and white proof in a grey world and approach these discussions with such a mindset. He wasn’t tested for alcohol shortly after the accident, in many countries that may not be sufficient proof to highlight he was under the legal DUI limit. 

 

In Thailand this may not be investigated, particularly so for someone of wealth and influence.... 

Your comments seem to defend this ideology not matter what. 

 

 

 

 

 

So now this is how to avoid a breath test, " I have chest pain" A blood test could have been done immediately he got to hospital, It is obvious to all and sundry that he was over the limit. Anyone watching the vid would tell you that. So what charges will be laid on him ?

Don't know if he was drink or just not a competent driver. Perhaps more money than ability.
