snoop1130 Posted July 31, 2023 Share Posted July 31, 2023 The Bangkok Metropolitan Administration will revoke the construction permit for the luxury Ashton Asoke condominium in Bangkok’s Sukhumvit area, as ordered by the Supreme Administrative Court, but the owner can apply for a new permit. Deputy Bangkok Governor Wisanu Subsompon said that, according to procedure, following a ruling by the Supreme Administrative Court, the city administration must revoke the existing construction permit adding, however, that it does not mean that the condominium building will be demolished. The owner of the condominium, Ananda Development, can apply for a new construction permit from City Hall. According to the Supreme Administrative Court’s ruling, the access to and from the condominium onto Asoke Road is located on land expropriated from private landowners by the Mass Rapid Transit Authority of Thailand (MRTA), for the construction of the Blue Line train project and, therefore, cannot be used for other purposes. As such, the land was leased illegally to Ananda Development by the MRTA. Picture courtesy of Ashton Asoke The fate of the troubled Ashton Asoke condominium hinges on the interpretation of three pertinent sections of the prevailing law, as explained by the Bangkok Metropolitan Administration (BMA). In a clarification of the circumstances surrounding the Ashton Asoke condominium dilemma, the Deputy Governor of Bangkok, Wisanu Subsompon highlighted the relevance of Sections 40, 41, and 42 of the Buildings Control Act 1979. These sections could potentially provide a legal pathway to prevent the demolition of the condo following the Supreme Administrative Court’s decision last week. The court decision voided the construction permit of the fully completed 6 billion baht condo venture in Watthana district. According to Section 40 of the act, appropriate officials are authorised to prevent the use of or restrict entry to a building that has been erected, altered, demolished or moved in violation of the law.
