Sean “Diddy” Combs, the embattled music mogul, is seeking a court-ordered gag order to prevent potential witnesses in his criminal case from speaking to the media. This motion follows a recent, highly publicized interview by a grand jury witness, who alleges he possesses tapes of Combs sexually assaulting several celebrities. According to court filings, Combs and his legal team are aiming to prevent extrajudicial statements that could impact his right to a fair trial.

 

The push for a gag order follows a series of media appearances by Courtney Burgess, a music producer, who has publicly claimed to possess eight tapes showing Combs allegedly assaulting eight different individuals: four men, two underage boys, and two women. Due to the sensitive nature of these alleged crimes, the identities of the individuals on the tapes remain undisclosed. These allegations come as Combs faces charges of sex trafficking and racketeering, stemming from accusations that he forced women to participate in multi-day “freak-offs”—extravagant parties involving drugs and sex. Since his September arrest, the claims have only intensified, with more than 150 alleged victims, including men and boys, coming forward. At least two dozen civil lawsuits have since been filed against Combs.

 

Combs’ legal team argues that the intense media attention has significantly impacted his chances for an unbiased trial. They contend that this “carnival atmosphere” around the case could prejudice jurors and are urging the court to issue an immediate order to prevent any further leaks or interviews. The initial request for a comprehensive gag order was filed in late October, and in a follow-up motion filed on Sunday, his lawyers asked the court to immediately bar potential witnesses and their attorneys from speaking publicly.

 

On the other side, prosecutors have expressed strong objections to such a sweeping restriction. They argue that to implement the proposed gag order, they would be required to disclose their entire witness list months before the trial, a measure they say is “unprecedented” and would pose potential risks to witnesses. Prosecutors claim that enforcing the gag order would be a “fool’s errand” and could expose witnesses to unnecessary harm. Following the interview, prosecutors summoned Burgess to testify before the grand jury in Combs' case.

 

Burgess, who says he doesn’t personally know Combs, explained in media interviews that he had encountered Combs’ associates in his 35 years in the music industry. According to Burgess, he obtained USB drives containing footage of Combs allegedly assaulting the unnamed celebrities, all of whom appeared to be under the influence of drugs or alcohol. In an interview on *NewsNation* with Ashleigh Banfield, he further claimed that the celebrities were unaware they were being filmed, as evidenced by the camera angles and locations shown in the footage. When asked how many of the individuals appeared to be victims, Burgess replied, “I think all, to be honest, all were victims.” He described the individuals as disoriented and seemingly unaware of their surroundings.

 

Combs’ legal team has called Burgess’s claims “false and outrageous” and maintains that no such tapes exist. In addition, they accuse law enforcement officials of leaking sensitive information to the media, including CNN, where anonymous sources have shared details of the investigation.

 

As the case unfolds, the question of whether a gag order will be issued remains uncertain. The court’s decision will determine whether Combs can prevent further media coverage that could impact the trial, or whether witnesses will continue to share their accounts with the public, potentially adding fuel to an already intense media storm.
