Hello all! I'm new here, so I hope I post in the right place. 

 

I currently in the process of getting a yellow tabien baan from a condo I own. For now I have only the blue tabien baan with the name of my wife and stepdaughter on it. We are getting a divorce soon, and I was wondering if I risk anything leaving the name of my soon to be ex-wife on it. For context : I will keep the blue tabien baan with me, and only send her a copy when she needs it. We keep a relative good relationship, no drama or crazy things going, we still help each other for a few things, no money problem whatsoever also, the separation is as clean as break up can be. But I just wondering if something could go wrong having my ex-wife name in my tabien baan as the headmaster. I was thinking to be headmaster myself, but unless I misunderstood the officer at the discrict office that not possible. What's your thoughts? Something to be aware/careful? 

If you are listed as owner, there shouldn't be a problem.

At the amphur when doing the divorce, get the condo listed as your sole property in the division of assets section.

 

If you don't speak or read Thai, take a Thai translator as your 2nd, your local police station will have a list, shouldn't cost more than 1,000bht for an official police translator. Don't let the translator chat with your wife.

On the title deed (chanote) there is only my name on it.

 

At the amphur, for the divorce, I still don't what the process gonna be, but I take note to get listed condo as my sole property in the division of assets section. I think I may ahv to do another post to ask what I should be careful about during the divorce paperwork at the amphur. ^^

If you are the owner of the condo – i.e., registered in your name on the title deed – you should have tha blue house book changed, so you are the "host" or "master-of-house". You will be registered as that in the yellow house book for foreigners. Only the host or master-of-house can decide who to be registered in the house book, including the yellow house book for foreigners.

 

It might be best to have your ex-wife's name removed from the house book; however, she need to be registered in another house hold to do that.

 

You can leave your stepdaughter's name in the blue house book. However, she will (only) be eligible for school etc. in the district where she is registered. If the stepdaughter is not staying with you and is not attending school in the same area, it might not be a good idea. If the mother register the child in another house book – easy peasy to do either with the host's permission or in a general village house book – you will be contacted by the authorities to have the name cancelled in the blue house book.
