The US Justice Department has been accused of stumbling through a crucial court hearing over its handling of Jeffrey Epstein files, with a lawyer describing the session as a “pretty crazy two hours” that could have consequences far beyond the immediate case.

Brendan Ballou, a former DOJ lawyer now with the Public Integrity Project, said the department appeared unprepared as a judge pressed its representative over disputed redactions.

DOJ lawyer left facing a barrage of questions

Ballou was in court as DOJ lawyer Andrew Block defended the department against a lawsuit brought by lawyer and journalist Katie Phang, who alleges that redactions to Epstein-related records violate the Epstein Files Transparency Act.

But Ballou said the government appeared to have no clear strategy for the hearing. There were “long periods of silence”, he said, while basic questions from Judge Emmet Sullivan went unanswered.

Most strikingly, Ballou said the DOJ never directly argued that it was complying with the law. Instead, its position appeared to rely on interpretations of previous court orders that allowed it to avoid certain requirements.

Judge raises spectre of contempt

The confrontation escalated when Sullivan reportedly raised the possibility of holding Block in contempt.

Ballou said the judge spent around half an hour outlining the professional consequences of contempt, describing it as a “promise, not a threat”. The warning suggested the dispute could move beyond arguments over paperwork and into direct judicial sanctions.

Millions of pages could be next

Sullivan also asked Phang’s team, rather than the government, to draft a proposed order for releasing Epstein files — a move Ballou viewed as significant.

He argued that the hearing represented only a small part of a much larger battle over millions of pages of records. According to Ballou, repeated failures by the DOJ to comply fully or provide transparency could strengthen demands for broader disclosure.

The central pressure point is now trust: whether the department can convince the court that the files have been reviewed and redacted properly — or whether the judge concludes that a far more sweeping remedy is required.
