Yes, those documents exist but aren’t public. Until they’re released, the cause isn’t definitive in the public domain. That’s also why Trump’s assertion is invalid.

The government contract and the manufactures specs are on line the only thing not on line is sworn affidavits, and NPS inspection reports there are plenty of reports from company which have used this product before saying it is the wrong product for the job

And it seems the courts do not deal in facts as there would not have been any charges brought in the first place

Trump claimed several times that there was video and photographic eveidence of these 'radical left' vandals cutting up the new lining of the reflecting pool. I imagine there's 24/7 video surveillance out there, so if there is video evidence, it shouldn't be too hard to produce. In fact, if there was evidence, Trump would be the first to post it on this Truth Social. But much like with his incessant whining about the 2020 election, it's all talk and no hard evidence.

The contractor who got the job for doing the reflecting pool was apparently a buddy of Trump's. Looks like he screwed up big time. But guess who's getting the job of repairing the damage?

Agree. Lots of evidence out there for shoddy and/or incorrect work and repairs done too quickly. Zero evidence of vandalism.

There is no judge present and no defense counsel, although witnesses can be called to testify. The GJ doesn’t determine guilt or innocence as it only has to determine whether there is “probable cause” to proceed to trial based solely upon the limited evidence it has seen.

This is why it’s a commonly heard joke that a US Attorney can obtain a Grand Jury indictment of a ham sandwich.

In this case, Pirro obtained the GJ indictment and made the claim that the US government had a “mountain of evidence” in the hopes of duping the defendant into a guilty plea deal. When he didn’t cave in, Pirro had no choice but to request dismissal of the charges.

The fact that there is no judge or defense counsel makes it all the more important that the US Attorney should have had very strong, credible evidence of a crime before going before a Grand Jury and potentially ruining someone's life and sending him to jail. This is very serious business, with a person's future in the balance, and needs to always be treated as such. As it turns out, she had zero credible evidence--and knew it. This is why she needs to be fired, disbarred, and then personally sued for defamation, due to her gross, lying, on-camera actions on national tv.

I think the public deserves to see exactly what was presented to the grand jury as probable cause evidence. Hopefully some judges will have the gonads to have it released.

I believe lying to a grand jury is a crime or at minimum likely results in loss of law license....and of course it all had to be approved by blanche...maybe we can have an attorney general with no law license...

Because "the poorly educated" aren't smart enough to see through his bs. If I had known sooner that so many people are stupid to that degree I probably would have gone in a different career direction in my youth.

I've never come across this in the media, but I think one of the factors at play is that too many Americans don't really understand that the implications of an election are not the same as voting for their favorite American Idol contestant.

No idea but for sure his life has been and likely will continue to be disrupted by false accusations and arrest and having his name picture home address etc blasted all over media along with death threats.....how dare him ride his bike around a public park and stop to look and even touch the damaged lining floating on top of a reflecting pool. Attorneys for Hearn have previously said the government “owes Mr Hearn an apology”.

“The Trump administration’s case against Davey Hearn should have never been brought,” his attorneys, including Levin, said on social media. “Its dismissal … does not erase the abuse of government power in arresting and charging a patriotic American who did nothing wrong.”

Hearn told the Associated Press that he had been detained by the national guard and US park police for five hours after stopping by the reflecting pool during a bike ride. He acknowledged that he briefly touched a part on the liner attached to the side and told NBC News the pool’s condition “was the same after I stepped away from the water as it was before I got there”.

Lawyers for Hearn have also called on prosecutors to disclose the legal instructions they gave to grand jurors about the elements of the criminal charge handed up against him.

“The grand jury transcripts disclosed to the defense thus far contain other irregularities that reflect a misleading presentation to the grand jury and a need for review of the entire grand jury record in this matter,” Hearn’s attorneys wrote.

Hearn’s opportunities for legal recourse against the federal government may come only after his attorneys petition the court to dismiss the case “with prejudice”, meaning that it could not be refiled. The justice department dropped the charge “without prejudice”, meaning that it can be refiled.

“We are responding with our own motion to dismiss with prejudice so that he is not longer at risk of being harassed by the government further,” Levin said on Tuesday. “Once that is resolved Mr Hearn will focus on what comes next.

“He’s considering all options.”

In a statement to the Wall Street Journal, Hearn’s attorney Norm Eisen said the team plan to go on the offensive against the government: “All legal remedies are on the table going forward to respond to the miscarriage of justice,” Eisen said.

The calls come after the Justice Department dropped charges against Olympian David Hearn and others, concluding that key information pointing to construction failures had not been disclosed.

Senators Sheldon Whitehouse and Martin Heinrich have urged the Interior Department's inspector general to launch an immediate investigation into the origins of the vandalism narrative.

In a letter, the lawmakers questioned whether Interior officials misled President Donald Trump or whether the claim originated inside the White House itself. They also demanded a full account of what department officials knew about the pool's defects and when they became aware of them.

According to reporting by The Washington Post, Interior officials publicly blamed damage to the Reflecting Pool's new liner on vandals despite internal evidence indicating the problems stemmed from contractor errors during installation.

The Justice Department later acknowledged that relevant information about engineering failures had not been shared with prosecutors, leading to the collapse of the criminal case.

Contradictions Under the Spotlight

Trump repeatedly claimed vandals had slashed a 250-foot gash into the pool's liner with "very sharp knives or razors", later increasing the alleged damage to 350 feet. However, inspections of the drained pool reportedly found no evidence supporting those claims.

The senators argue Interior Department records instead point to a rushed installation, repeated failures during construction and widespread peeling of the liner as the true cause of the damage.

Political Fallout Intensifies

The controversy has deepened after Interior Secretary Doug Burgum continued to publicly blame vandals even after the Justice Department concluded faulty installation was responsible.

The Interior Department's inspector general has yet to say whether it will open an investigation. While the watchdog operates independently, growing political pressure is likely to keep questions over how the false narrative emerged at the centre of Washington's latest accountability battle.
