The latest developments for foreign nationals residing in the USA have become a topic of much discussion. Immigration Enforcement and the current administration policies at airport checkpoints are being scrutinized like never before, with many left wing advocacy organizations warning foreign nationals to stay away from airports in the USA.

The Executive Branch is legally executing statutory authority under federal law. Filing an application that creates a different immigration status is an administrative deferral only to the extent that executive policy chooses to respect it: when enforcement policy tightens, the underlying statutory violation (8 U.S.C. § 1227) provides full legal grounds for ICE to arrest and detain the individual.
