Non-o Visa Application

Hello,

I have a question regarding the Non-O Visa.

I have been told, that either my wife or me (or us together) have to earn at least 40,000 Baht a month in order to get me a 1 year non-O visa.

My wife has her own business and a part time job, she is making a lot more than 40,000 Baht a month.

Her business is a private business, so her customers only give her the withholding tax slip. She doesn't have to file any tax report herself.

What type of paperwork do we need to show the immigration, in order to get the 1 year non-O visa?

I would prefer to only use the income of her business as proof of an income over 40,000 Baht, as she is pregnant and will probably quit her part time job in the next couple of months.

She should be filing tax payments and that proof is what will be required by Immigration for one year extensions of stay. A one year non immigrant O visa is a different item and issued by Consulates. Very few will issue more than a single entry and then you are expected to use the immigration extension of stay if you want to remain in Thailand. Currently Singapore seems willing to issue a one year multi entry non immigrant O visa with proof of at least 400k in a bank account and the normal marriage paperwork items.

Is the withholding tax slip enough? It says the total amount on it and how much tax has been withheld....

400,000 Baht on the bank account... I thought they stopped that?!

Currently we don't have that much on a single bank account, but could easily fill one up to 400,000. I heard the money has to be in the bank account for 3 months, is that correct? Because then, I would rather go with the 40,000 Baht income, as we can fulfill every criteria for that right now.

I am currently holding a 3 month non-O visa, would it be possible to extend it in Bangkok Immigration to a 1-year, or do I HAVE TO leave the country?

You need tax documentation for the extension of stay proving an income of 40k per month or more. Only the office itself can provide a sure answer on what will be acceptable (as it has changed several times). The 400k is not allowed for new applications for extension of stay - only those grandfathered.

For visa issue at Singapore they seem to allow a one year multi entry visa to be issued - this allows unlimited entry/stay of up to 90 days at a time. But you must travel to another country every 90 days or less.

I have been told, that either my wife or me (or us together) have to earn at least 40,000 Baht a month in order to get me a 1 year non-O visa.

Is this a new rule ??? Should be interesting if someone can confirm this.

The rule is 40,000 Baht family income for new aplicants and has been in force since October 2006.

We are talking about a Thai spouse. It has been the law for over a year - Police Order 606/2006 section 7.17 - 40k monthly family income.

Yeah his wife is 100% Thai born in Bangkok... Maybe he wants to go to Cambodia for casino thats why lol he goes out every 3 months

Just apply for a 3month Non 0 visa, then a one year married visa before the 3 month expires...both no problem if you have joint income of 40k Thb or more per month and are genuinely married. Thats what I did, now I just renew the one year married visa with the statements showing our joint income. Seems pretty simple if all papers in order.

You do not renew your Married Visa every year as there is no such thing.

Every year you renew your extension to stay based on having a Thai Wife.
