Can any one help

I have a brother who was just arrested for a drug offence at Pattaya.

I live in Australia, and have been contacted by his lawer who informs me that if i can come up with $xxxx thousand dollars they will be able to help him by keeping him in Pattaya other wise he will transfered to a much worse place.

I am not argueing about his guilt or not, just wondering if the info i've been given could be true or a con

Paying money to Prosecutors in Thailand for privileges and or reduced sentences is a part of the the system here. I cannot advise on your best approach but suggest it might be best to retain the services of a good Law firm in Bangkok or elsewhere. I wish you good fortune.

Best of luck to you. The legal system is a little like going to the casino--you might win or you might just lose your money. Previous post is good, get a good law firm and take their advice.

In the meantime, while you are waiting to brief a Thai lawyer, try to ignore the inevitable posters here who will demand your brother's immediate life imprisonment, and/or call for capital punishment.

It's a bit of a crap shoot but there are firms in Bangkok and elsewhere that can help but it's an issue of cost versus the "name game" - Clifford Chance operates out of BKK and they are huge internationally, question though whether other smaller firms might not be able to do the same thing at a cheaper price - let me look at some notes and I'll PM you. For the moment though I suggest you do nothing until you sort out a direction.

You should re-word your question, not how, but does it work? Corruption is deeper then we think!

Whatever you do, don't go and give this lawyer any money. Thai lawyers are infamous for being some of the worst corrupt people the country has to offer. Especially, ones who work out of a shop building.

I know one family who paid almost 1million baht to have quite a serious drug case made into a not so serious one. The money made no difference whatsoever, and it all went into the cops and lawyer's coffers.

Let me warn you that a lot of local lawyers will work secretly with the police to coax as much cash out of you as they can (if they know that you have a lotta spare cash)

If you are gonna hire a lawyer, your best bet is one from a reputable firm. They may be much more expensive than a local one, but in the long run you could save a lot of money.

Thais themselves are very cautious in regards to hiring a lawyer, so you as a foriegner, have to be extremely careful. Especially, when it is a criminal drug case like this.

Absolutely. The OP's brother's lawyer has already shown his hand in this regard. With much less than those "$xxxx thousand dollars " you can hire a reputable lawyer.

Good advice there. Lawyers in Thailand are often nothing more than hired phu yais ("big man") , a Thai cultural concept reflecting the more traditional patron-client relationships that don't exist so much in the more modern urban environment. Bottom line is expect to pay just as much in Thailand as you would in your home country for a top notch law firm, maybe a little bit more, but you must argue hard for some contingency fee arrangements based upon the successful release of the accused. I mean no reason to pay a bribe if it isn't followed through.

I have read all the posts and see good advice being taken. Just note that the 'lawyer' who contacted you just wanted money to keep your brother 'in Pattaya' which is tantamount to asking for money to make the lawyers job easier, ie. no need to travel far (assuming he is a Pattaya-based lawyer). He hasn't asked for money to ensure that the rule of law is followed or make a good defense which is what a public defender (assuming that is what this 'lawyer' is) should be doing.

Good luck and don't forget to kick your brothers arse.

The Thai lawyer that I presently use advised me NEVER to give a Thai lawyer Power of Attorney or make them Executors of a Will. You will almost certainly be ripped off he said. He added that he never provides these services in his practice to avoid temptation.
