Fiance Visa For Usa/gf Had Prior Marriage But No Papers Filed

Featured Replies

Hi, I'm thinking about bringing my gf out to the US next year on a fiance visa.  About six years ago, she got pregnant by a younger thai man (I think she slipped her a date rape pill).  Anyway after one encounter, she became pregnant.  He parents required her to marry the man but advised her not to record the marriage with the local authorities.  I think this was about saving face in the village.  NOW I come into the picture.  How does this "marriage" affect my ability to bring her over to the US and marry her here?  In about six years, I'll be moving out there and will this prior marriage affect me?

She is not married, so no problem.

A marriage must have been valid at the time and place it was performed. The validity of a marriage is generally determined by the law of the place where the marriage was performed or celebrated.

The USCIS always takes into account the following requirements when the alien wishes to enjoy the immigration benefits from the marriage:

1. Each party to the marriage must have been legally able to marry;

2. Any prior divorces of either party must have been valid; and

The marriage must be recognized as legal in the place where it was performed

So nothing to worry about.
