Now the whole element of key money adds a unique dimension to this struggle. Working tirelessly to make a business thrive only to be "forced" out by rediculous sums of KM is hardly encouraging.

Key money is not necessary a bad thing as long as you have your eyes open for the future. Realise the risks and rewards. Have your lawyer draw up a contract spelling out what the maximum rent increase with key money can be charged in 3 years and for an additional 3 years. Under the Civil commercial Code that’s the maximum number of option extensions an entity can have is two extensions. However you can put in the contract that another entity will be entitled to the lease in year 9-12 and permission has been granted by the landlord.

Make sure your contract does not simply have option to renew. Under the Civil Commercial Code both parties ( Landlord and tenant) have the option to renew unless its spelled out that that legal right of the landlord has already been granted to the tenant for the renewal. In this case, only the tenant has the right to decide every three years.

The best option is to register the lease with the Land Dept. It can be up to 30 years. If it’s a tax issue… tell the Landlord you will pay the tax for the registration.

Anyone else notice how my post pointing out and correct 3 blatent factual errors regarding Thai law that the self-purported legal advisor Sunbelt makes here above was deleted? I was then given a waring for "flamming" :o Another example of how heavily censored this "forum" is...and in this case, if you point our anything embarrassing, true or not, helpful or not to you the forum readers...it will removed. Sure I will now be excommunicated from the forum...BUT won't be the first time and not the last I imagine! :D

do you have any proof that you are right on this issue? If not then you are no more of an expert than you claim sunbelt to be. And as per the forum, rules, which are very clear, we do not allow flaming against individuals nor our sponsers. So you will find that is why you were warned, not because we are "heavily censored" as the rules are there for all to read & you agreed to abide by them when you signed up. Suggest you have another read before posting again so you don't gain yet another warning.

Your business will be open / keep you busy 60-70 hours a week. Shop and bedroom should be close together.

Hang on. Flaming is posting insulting, non-constructive personal attacks.

Thaivisa rules say:

Flaming' is best defined as posting or responding to a message in a way clearly intended to incite useless arguments, rants, and/or for launching personal attacks, insulting, being hateful, useless criticism, name calling, swearing and other bad behavior or comments meant to incite anger.

Seriously, the poster in question didn't even come close to this.

The poster in question was simply pointing out what he considers to be factual errors. And he did so in a reasonable manner. Hardly inciting "useless arguments."

If this was flaming, you could just as easily point to the subsequent posts by Sunbelt as being flames. In fact, anyone posting a contrary position could, under this broad definition, be considered flaming.

But I have to extend a tip of the hat to Boo for allowing this mini discussion instead of automatically deleting everything and then suspending everyone in sight for a week (been there). By the way, this is about the nature of flaming, not about moderation :o().

Yeah really sbk. Your are exaggerating without reason here. (And i am not talking about moderation witch is not aloud, im talking about sbk the poster.)

And joeyb, i also agree btw with you and mark so now we are 3 at least. :o

Seeing that this topic has degenerated into a discussion on the meaning of flaming and noting new is being added on topic, I am closing this thread. It seems that everything that could possibly be said on topic has been said.
