I run a small company in Thailand, I have a non-immigrant B visa and a work permit already. The visa expires in August. I was told by my embassy in my home country upon receiving the current visa that next time I don't need to come back to get the visa, I can do it in Thailand. This would be convenient, but so far I have not found a procedure for this. Was I misinformed? Has anyone done this?

If you qualify for one year extension of stay from Immigration you would not have to obtain a visa - you can not obtain a new visa in Thailand - only the one year extension of stay (if qualified). You must also meet miminum wage requirements of police order 606/2006 attachment http://www.immigration.go.th/nov2004/2notice/rtp608EN.pdf

List of documents required for business purposes.

Application form (TM.7)

Copy of applicant’s passport

Certificate of employment prepared in accordance with the form prescribed by the Immigration Bureau (Sor.Tor.Mor.1)

- A table showing the numbers of all foreigners employed by the company, also their salary on monthly and annually basis, and their total salary, is additionally required.

Copy of work permit

Proof of corporate registration e.g. certificate of incorporation of company or partnership certified by the Registrar with validity for 6 months

Copy of list of shareholders certified by the Registrar with validity for 6 months

Copy of latest balance sheet and income statement certified by the Revenue Dept. or Business Development Dept. or the Auditor or original documents only

Copy of latest monthly withholding tax return showing the name of employees and the alien applicant, together with receipt (or an explanatory letter)

Copy of latest personal income tax return of the applicant, together with receipt (or an explanatory letter)

Copy of latest monthly social security contributions return filed with the Social Security Office (Form Sor.Por.Sor. 1-10)

Proof of the need of the business to employ the alien e.g. no Thai candidate has applied after advertising such a position

Location map of the place of work

Other supporting documents required by the competent authority (Sor.Tor.Mor.2)

Photographs showing the location of the business a. Exterior photographs showing the address and the sign of company name b. Interior photographs showing the employee while working

Original documents of Nos. 5,6,7,8,9 and 10 must be provided.

In case the applicant are accompanied by the family member, proof of family relationship e.g. marriage certificate, birth certificate of their children must be provided. If these documents were issued by a foreign government, they must be certified by such foreign embassy.

Has anyone done this?
Yes - exactly as Lopburi3 says above, as long as the company is functioning with your taxes etc paid to date - you get your WP stamped with the extended valid until date along with your Passport permitted to stay until date. Still need to confirm address at 90 day intervals. Quite easy no need to leave the country.

I have in the past wished I could do the same but unfortunately, as far as I am aware, you must obtain it outside Thailand.

Quote from the Thai Consulate Hull UK Applying for a Visa -

"The Non-Immigrant Visa can be obtained only from the Royal Thai Embassy or Royal Thai Consulate and it must be obtained before you arrive in Thailand. It is not possible to obtain a visa in Thailand."

The advice from Hull is correct.

Visas can only be issued by Thai embassies and consulates overseas.

However if you meet the right requirements Non Imm visas can be extended for one year, inside Thailand.

If you qualify for an extension of stay I believe the step-by-step procedure is as follows:

1. At immigration, get an annual extension of stay.

2. At the labour office, get an extension of your work permit to match your extension of stay.

But recently I read in a post of Sunbelt’s that in Bangkok the labour office is now giving an annual extension of the work permit even this will bring the work permit’s validity beyond the permitted stay’s validity. In other words, I am confused about it; the procedure may have changed.

I always have to go to the labour office first. They give me a paper stating that I can pick up my WP (extention). With that and all other papers I go to immigration and then show the stamps from immigration to the labour office and they will stamp the WP. But that is Uttaradit, not BKK.

What you were told is true. You can even convert a visitor visa, with at least 21 days left on it and go to Thai immigration and apply for a non-Imm visa. This has been in effect I believe since January 1, and makes perfect sense that Thai Immigration has adopted this policy. I applied for my non-Imm O at Mai Sai...and had no problems, and I had a 30 day Visitor Visa. The labor office and Work Permit is another issue, and you still do not need to leave the country.

If you qualify for one year extension of stay that can be done at an immigration office inside Thailand - and if you arrived on a visa exempt or tourist visa a single entry non immigrant visa could be issued to allow the extension of stay. But you must meet the qualification - which means the company having required Thai employees, profit, your salary meeting nationality requirements and such. Most new companies do not meet requirements in first year.
