I am UK passport holder, with work permit, living in Thailand. . I have a 5 year old son , who holds a UK passport which expires October 2008, and a Thai one already expired. I am divorced from a Thai national, and my son has been living me full time since our divorce . I want to re-new his Thai passport but I realize I cannot do so without my ex-wife's signature etc . She has agreed to sign all paperwork for this in October time. The problem I have , I wish to go to London for a holiday in August for 10 days . When we return to Thailand his passport will only have 2 months validity. Will they let him board in London ? I have all his paperwork birth certificate etc

I spoke with local immigration who advised me he is okay to travel back in on UK passport , as no overstay for kids and soon will have his Thai passport back. I'm more worried about his UK passport validity, as I read on entry into Thailand foreign passports must have 6 month validity. Any help very much appreciated. Worse case scenario will re-new his UK one before we leave. He has traveled to London twice previously with me , using both passports.

The question is who has custody ofer the child. If you have sole costudy you can apply for a Thai passport for your son, whitout your wife.

Otherwise the question of will they let him board in the UK to return to Thailand depends on if you can proof his Thai citizenship. His old passport might help to proof that to the airline and immigration. You might contact the airline by email so you have it in writing and see what their response is

When we got divorced the papers just say 50/50 custody , nothing specific, so I would need her to sign for Thai passport. Although she has agreed in October to sign paperwork to give me full time custody of him. ( next time she is in Thailand )

Thanks for idea re contacting airline, will give it a go. I have travelled twice before with just his passports and no consent letter from ex-wife. Its just the fact that he will only have 2 months left on UK passport on arrival in BKK that worries me.

I would get the new UK passport - you need it in any case and expect you have time to do before the trip. Never let passport get below six month validity - the UK even adds the missing months to the validity of a new passport so you lose nothing for doing it a bit early.
