I'm French, in my 30s and presently in Thailand on a tousist visa obtained in Vientiane.

I'm recently married (Thai wife) and we have a daughter born in Thailand, my name is on the birth certificate.

My income is derived from an offshore company, on an offshore bank account, but I have a Thai bank account I can transfer the money to if necessary. Income is very irregular, but usually over 40,000 THB/month.

Does this allow me to get a better visa than tourist visa, ie won't need to get out of Thailand every 3 months?

You could obtain a non immigrant O visa but would still have to leave every 90 days. Perhaps the wife should pay back tax and then pay the 2-3,000 baht per month in tax that would be required if her income is 40k per month from that job you got her?

Wife is not employed, she takes care of our recently born daughter. This is indeed work, but not one bringing her any income, so how could she pay taxes? And what would that change for me if she was paying taxes?

Tax office is not interested in the job. From others reports it runs between 2-3,000 baht per month. If you have regular income above 40k that your Embassy could state on a letter that could also be used at most locations (but your post did not sound as if that was the case).

Nope embassy cannot certify my income.

So wife could go to the tax office, say that she earns 40000 THB/month, pay taxes on this, then I could use her tax certificate as justification for my non-imm O, right?

And tax office will not ask her where this income comes from?

Would that allow me to get a one year extension on a non-O, ie reporting my address every 90 days instead of leaving the country every 90 days?

You would use for one year extensions of stay from Immigration. You can obtain a single entry non immigrant O visa at any Consulate with marriage proof and copy of her ID card/home register. In KL you might be able to obtain a multi entry valid for one year of 90 day stays with above and a note from wife asking they issue and perhaps a bank account passbook showing some funds in Thailand.
