Hypothetical Mariage Extension Of Stay Question

Featured Replies

If one marries and gets an "O" visa for marriage, and then circumstances lead to a divorce, can the foreigner marry again to another Thai and still qualify for extension of stay?

Not as crazy a question as it sounds. Does anyone have any experience on a situation like this. Primarily as it relates to PR application after 3 years extensions on the same visa.

thanks in advance

If you are on an extension of stay you are no longer allowed to stay in Thailand when the reason for your extension of stay is no longer there. On a non-B you would have to leave the country immediatly when you lose your job. On a non-O based on marriage to a Thai you would have to leave the country also, but unsure within how many days. You would be able to get a 7 day extension of stay. If you were to remarry within that 7 days there should be no problem regarding your stay or PR.

I been married for more than 4 years now and tried THIS year to get an extension based on marriage at Sri Racha immigration but they told us that the government seems suspicious about marriages between thais and farangs because they use the system to get an easy reason to stay here.

We was adviced to apply for extension based on retirement instead of marriage.

Anyway i hope you can get your extension based by marriage, pls take your wife whit you to immigration and hope they will grant it for you,, maybe you are less than 50 years too and thats a good reason to apply for marriage extension.

Good luck to both of you.

Regards

Yes, less than 50. And deciding whether to GET the marriage visa, currently at the end of several visa exempt stams.

Note that you have to be in Thailand for 3 years on extensions of stay. The reason for the extension of stay doesn't need to be the same. You can get an extension of stay based on marriage to a Thai, the next year because you have work and the next year because you meet the requierements for an extension based on retirement.

Better also check the tread about acquiring permanent residency, if you didn't already.

They suggested the retirement extension because it is less work for them. (It is also less work for you)

The suspicion about marriages of convenience to get extensions of stay easily is in fact written into the currently valid extension rules that require proof that a marriage is also de facto (real), not just de jure (marriage certificate). It is the effort of collecting and assembling this proof that that an immigration officer shuns.
