Help Needed Please

I am a UK Citizen with a Thai Wife with a UK Passport living in the UK.The problem i have is my wifes niece who is nine lives in Thailand with my Wifes parents.My wifes sister is nowhere around believe to be in Pattaya but not heard from in two years.My Wifes Mothers health is not good and is finding it hard to look after my niece.We have said we would bring her to the UK to live here or to give her parents a break.How do i start to look into the process needed and how do i apply to bring a 9 year over or would my wife apply.

any help appreciated

One thought might be for your wife to adopt the niece here in Thailand then as your step-daughter apply for an immigrant visa. I don't know the UK rules on this, I'm a Yank, but might work. Sort of long term process, tho, the Thai adoption. Could well take 6-9 months depending on the province the niece is living/registered in.

For Aussie Citizens (Although UK has much the same rules); Dependant family member can get special consideration on hunamitarian grounds immediately in certain circumstances. Your wife would need to sponsor, as the supporting family member. I would look into adoption at a later date is the matter is urgent. My mate was in the very same position and felt a sense of duty to the neice in law. Admire your conpassion, many would not take on the sort of responsibility as the costs to look after a child are very high.

I cannot help on the UK side of things.

On the Thai side I can see a problem in that what ever you do somebody is going have to find the mother to sign off on some paperwork. It may be a matter of her granting your wife sole custody of your niece.

One consideration is the house registration book that the niece is in and does you wife have one her own.

Just for the Thai side it may take a lawyer to sort things out. Just somethings to think about.

As she is your niece there is, I'm afraid, no way you will get a visa for her to live with you in the UK.

Were you to legally adopt her then it may be possible. See Chapter 14 - Settlement entry for children, especially 14.8 - Adopted children and how they qualify.

Adoption, especially of a foreign child, is a complex matter and you should seek specialist legal advice.
