Hello, I am a falang musician working in thailand. I accepted a job and have been working in a niteclub. The owner isnt really legal as such so the bandleader has a connection w/a guy who works for a large hotel and he has listed me as an employee of said hotel in the capacity of a musician,and has started the paperwork w/whatever agency handles those things,i forget.But club owner put out 12k bht to start the ball rolling,but now i hear that a w.p. is only good for one venue and the hotel is not affiliated in any way w/the club.So if i got visited by immigration,the w.p. would not save me right? Anyway the clubowner is way behind in $$ to me for services and i may not work there much longer is he doesn't come up w/some $$ soon.Meanwhile the guy who is doin the w.p. wants me to go to immigration w/him to sign the papers, pay taxes and finalize the deal,but i dont want to pay taxes on $$ i havent even recieved and concievably be on the hook for 2k bht a mo. when i might not even be working there much longer especially since the w.p. isnt gonna save my butt if i get the visit from police or immigration.Plus when the w.p. terminates,i lose my non-immigrant type B status. So i'm considering not even going to immigration to finish the paperwork but i'm wondering all the possible consequences of such action.The keyboardist who has been here 10 yrs. doesn't have a w.p. and isnt worried.I'm just wonderin what immigration would do when they see this unfinished w.p. paperwork(they have my address here i think when i filled out the paperwork) but they dont know where i'm working.What should i do???Your expert advice would be greatly appreciated.Thank You Very Much

I think you could work for the hotel as long you were to have a contract with them saying that you worked for the hotel and they hired you out to other establishments and it was put on the work permit application that way.

Of course to make this legal they would have collect taxes from your pay and etc. If all this was done properly you could get a one year extension.

I assume that you have a single or mutlple entry B visa. If the work permits ends it will not affect your visa. If on a one year extension the moment your employment/work permit ends your extension ends and you have to leave the country.

If you are caught working without a work permit you would be in big trouble.

There will be others posting here soon. Most with more knowledge of work permits than me so wait until the come along before makeing any decisions.

This is what Police Order 606/2549 says about extension of stay for musicians.

7.16 Actor/actress, singer, or

musician who is working for

any hotel or company, that

engages in entertainment

business in the Kingdom of

Thailand, that have the

paid-up registered capital

not less than 20 million

Baht shall be initially

granted a period of stay in

the Kingdom of Thailand

not exceeding 120 days.

(1) Foreigner obtains VISA for the

temporary stay and

(2) The employment is confirmed by

the related hotel or

entertainment company in

Thailand that has the paid-up

registered capital not less than

20 million Baht.

1. Application form

2. Copy of passport of the applicant

3. Copy of WP

4. Copy of an employment

agreement showing that the

applicant is being employed as an

actor/actress, musician, or singer.

5. Copy of the certificates of

business registration of the

employer’s company which is

certified by the registrar not longer

than 6 months.

6. Special for the entertainment

company, the company is required to

submit the shareholders list which is

certified by the registrar not longer

than 6 month.

7. Copy of the Withholding Tax Form

showing the name of the foreign

applicant and the receipt of the latest

month.

8. Copy of the evidences of the

personal income tax of the foreign

applicant in the latest year and the

receipt (if any).

In my WP it says where I can work.

I think though it's possible to not have it specified for ex musicians.

I have a friend of my that have been working as a musician here for years.

I don't think he goes through changing his WP every time he has a new gig.

Check your WP if it has a specified address where you can perform.

And of course some $$$ takes you a long way in this country.

i think the work permit has always a place where you work, this is normally the adress of the company employing you but depending of the nature of work like consultant, musician, etc the adress is not use against you in case of check BUT this is my understanding absolutely not something coming from the law/regulation of alien exmployement act.
