My thai girlfriend and i have been together for two and a half years, she has been here on a visiting visa first and now a student visa which finishes soon.

all we want is for her to go back to thailand apply for working visa then come back to the uk work full time as waitress at the local spa so we can both save money for two years get mortgage and maybe then marry.

it feels like our life has come to a grinding halt with the new laws, we dont want to marry just for visa and do not want to take this route.

our points on the points based systems doesnt add up for her to get visa even with esol english grade.

what shall we do anyone in similar situation???

its just boy and girl who want to be together work hard get house and enjoy life in the uk!!!!!

oh yeah she has been working at this spa for the past year and they have wrote letter to say they want girlfreind to work here again etc but the company doesnt have license for outside eu migrants with border agency

From what you have said she is not going to get a work permit.

One of the major criteria for a work permit is that the employer has to show that they have been unable to fill the vacancy from within the EU. Not going to happen for a waitress, sorry.

It seems to me that if she wants to stay in the UK with you then the only option is marriage, unless you can show that you have been living together in a relationship akin to marriage for at least 2 years in which case she can apply for an unmarried partner visa.

if you both really want to be together perhaps you should consider marriage and moving to thailand for a year or two. from here then you will have a much better chance of securing her a visa to move to uk, and from there a permanent stay visa or passport.
