If a person is involved as a defendant in a criminal case is his work permit compromised ?

Possible, would guess it would be indirectly, if someone did something which warranted his visa getting pulled, then work permit would go as well...

Suppose it all depends on what exactly the criminal case against him is....

It's fraud.

I understand his Visa has been suspended and his passport retained by the court and he is on bail.

But it's only hearsay as I don't know for sure of all the facts.

Just wondered about the work permit situation.

I stand to be corrected, if his visa is suspended than his work permit will be suspended as well becasue you cant have a work permit without a valid visa, would suspect having a work permit will be the least of his worries.....

Hard to say.

Normally a visa gets only canceled when convicted of a criminal offense.

So they should not suspend his visa yet, on the contrary when it runs out he should be getting 90 day extensions.

According to the recent updated "Order of the Royal Thai Police Headquarters No.777/2551, Re: Rules and Conditions in the Consideration of Alien Applications for Temporary Stay in the Kingdom of Thailand", item 2.26 :In the case of litigation or judicial proceeding:Permission will be granted for a period of not more than 90 days at a time.

It stipulates that following persons will get the extensions: complainant, the aggrieved party, accused, plaintiff, defendant or witness.

I would say the same is true for his work permit, it should not be canceled until he is proven guilty, on the other hand the judicial system found the evidence strong enough to arrest him and subsequently grant bail, so it's possible the labour Department can cancel his work permit based on that alone.

Add to that the fact that it would be impossible to extend his work permit without having access to his passport!

For the last couple of WP extensions all I provided was signed copies of my passport.

For the last couple of WP extensions all I provided was signed copies of my passport.

May vary office to office, as my last 3 years on renewals, I have had to turn up in person as they wanted to see the photos in passport, work permit and the person standing there were all the same.

Prior to this we used to just send off your passport and work permit every year and it used to come back all stamped up..

For the last couple of WP extensions all I provided was signed copies of my passport.

I only had to go in person when first applying for my WP, subsequent extensions required copies (signed) although the person handling my paperwork also with her my original passport.

Am now in the third year doing it this way, and at Chonburi Labour Department which is not the easiest around to deal with :o

A WP will not be valid past the date of the permission to stay. When applying for an extension of his WP OP has to show his passport to show his permission to stay. Also on a photocopy they will check his permission to stay.
