What Happens If........?

A simple question:

What happens if your condo developer refuses to have an AGM or does not reply to any emails? or meeting of any kind?

I feel they have something to hide.

Sinking fund still there? Used it for something else?

Maintenance of condo etc. shouldn't owners be informed of any money spent on the condo?

Condo is 2 years old now.

I bet your are in a Waterford Condo

This is the normal way they do things and if you try to create a resident committee as allowed by law they will cut of your water and take you to court. The story is very long what they try to do to stop you using your rights. Yes you will have to take them to court to get accesss to your sinking fund and you might get it after several years though the courts.

Be warned, give Waterford condos a miss.

I bet your are in a Waterford Condo

Tell them a group of you will take out a half page advert in the Bangkok Post

to warn any new buyers about this place if they dont play ball. :o

And you think the Bangkok Post would print it?

Even the local police turned up one time to support Waterford against the tenants. The central police had to be called in to get things sorted when Waterford turned off the electricity to the whole complex. Many years in the courts have followed and Waterford is still withholding millions of Baht in sinking fund and other things.

But seriously there must be a way to find a weakness ?

Presumably you have consulted the BEST lawyers in town ? What do they say ?

If you cant resolve this problem is sends a very bad message for condo ownership in Thailand :o

You can resolve it, but it is Thailand and it will take years through the courts. Even when you win the case you have to wait for the appeals. It takes years through the courts. Waterford is still holding 14 Million Baht sinking fund and many other things. It is not just one court case but many court cases, they just make it as difficult as they can for you.
