Hi Guys,

The mrs has had her application delayed and they have asked for an interview. In the meantime they have asked for the following:

"Evidence from independent sources that relationship is genuine and subsisting".

I am getting letters from my parents to say we stayed their when we first arrived back in the UK and also have photos of various nights out etc, but what else can be done?? I have bills that are for our address in her name and different ones in my name showing that we are both staying at the same address.

They have also asked for proof of savings etc but we have only ever saved in cash. If I get a letter from my boss saying we used the companies safe at work to store cash will that pass??

Sorry, it is for the EEA Family Permit.

We have already been in the UK for a year but had to get the passports back for her to travel before we got the 5 year extension.

Sorry, I actually put the wrong word there. They have asked for an explanation.

It is not quite true, we just save cash as I keep all savings seperate from current accounts but have no desire for another bank account. Obviously any letter would be on headed official paper from the office.

Still confused.

Are you an EEA national and your wife is living with you in the UK with an EEA Family permit and she is applying for a residence card or permament residence?

OR

Are you a British national, your wife is living in the UK with a spouse visa and you are moving to another EEA state and applying to the embassy of that state for an EEA family permit for her?

Sorry,

I am both a UK and EU national. We have been living in the UK for the last year together on an EEA Family Permit visa which we were applying for the resident card. Due to the fact that my wife had to travel we have had to apply for a new EEA Family Permit.

We use the EEA Family Permit route instead of the UK settlement route is to avoid the stupid high cost in getting a UK visa and also the fact that you can get the 5 year resident card.

Sorry, still confused.

If your wife is living in the UK with an EEA Family Permit she is allowed to travel outside the UK.

Why has she had to apply for a new permit, why can't she use the one she has?

Sorry to confuse you more.

She was in the UK but has had to travel back to Thailand, this is why we had to ask for her passport back. Her current EEA Family Permit has expired which is why she has had to apply for a new one now that she is over in Thailand.

So, she entered the UK with an EEA Family Permit, applied for her residence card but had to withdraw the application as she needed her passport to travel to Thailand, presumably for some emergancy. Whilst out of the UK her Family Permit expired so she needs to apply for another one.

Did you explain all this to the embassy?

Normally EEA Family Permits are issued fairly quickly, and all that is required is proof of the marriage, evidence that you can support yourselves in the UK and that the EEA national is exercising his/her treaty rights in the UK. However in this situation, a second application, I am not surprised that the embassy want more details. Especially, with respect, if the informatiom you provided with the application was as vague and incomplete as that yopu initially provided here.

As well as your marriage certificate and the documents you provided with her original application you should provide evidence to show that you have been living together in the UK; letters, bills, bank statements, official documents etc. adressed to either or both of you. If you have any letters from the BIA regarding here withdrawn residence card application this will be good.

You should not need to have any savings as long as your income is sufficient to support you both. Provide pay slips, current account statements etc.

I would be extremely surprised if they would accept a letter from your boss saying you keep all you savings in his office safe as proof that these savings exsist. But you could try. How did you deal with this last time?
