Morning all.

We have been married for 18 months and have a 3 year old daughter, I have decided to have her educated in Sydney, so we will reside in Oz in another 7 years when she is ready for high school. Should I apply for her mothers PR visa now? in Bkk, or from Sydney? or wait until we decide to move there? We now visit Oz every 12 - 18 months holidaying. Happy New year!!!!!!!!!!!

Hi John,

Firstly, you don't apply for your wifes spouse visa, she does. You would be your wifes sponsor.

To apply in Australia (onshore), your wife would have to be present in Australia, and hold a substantive visa without the 'no further stay' condition attached to her visa. If this condition is attached to her visa she will not be able to make an onshore spouse visa application.

You might want to look at an offshore application from Bangkok.
