Hi,

Im married with a Thai woman and we have a six month old baby boy. We are planing to go to Thailand for 5 month. We want to apply for my sons Thai passport. We have all the required papers like Thai birth-cert etc. already.

I for myself got a Non-IM-O visa.

The question is now: do I also need to apply for a NON-IM-O visa for my son? Or is it good enough to enter Thailand with his German passport and he will get a 30-days visa on arrival? But if so, do I have to fear he overstayed his visa after that 5 month (but on the other hand, as a Thai national he doesnt need a visa at all, right)?

Does he gets a leaving stamp in his German passport as soon as he receives his Thai passport or do we have to cross the border after 30 days to get the leaving stamp? Or is it possible to get the leaving stamp at a Thai immigration office (not at the border)?

Can someone help please?

You could get your sons Thai passport before leaving at the Thai embassy or a consulate in Germany.

If not then he can enter Thailand on his German passport and get a 30 day visa exempt entry. After getting his Thai passport you could then cross the border and re-enter to get the departure stamp and he would then return using his Thai passport. You might also go to an immigration office and see if they could cancel the entry. I have never heard of it being done but it might be possible.

There is no overstay for a child so it would not be that big a rush for him to leave.

If your son enters Thailand using this German passport then he must leave using the same passport. If he does not get a departure stamp, his permission to stay will expire, he will be on overstay, and in the country illegally. When your son enters Thailand on a German passport, he is German for immigration purposes. Not to worry, children are not prosecuted for overstay, but the lack of an exit stamp could conceivable cause grief in the future.

Best to get a Thai passport for him in Germany before travel.

I would try the immigration office route first. I think they will do it since he is a Thai citizen and will have a new passport to show.

If that does not work then at some time or the other you will need to take him on a trip to the border or fly somewhere to clear the entry stamp in his German passport.

As I said before they do not charge children for overstay so it is not big a rush to do it.

I see little or no chance of getting the arrival stamp in the German passport cancelled at an immigration office. The arrival in Thailand will be a fact that cannot be undone and will be recorded not only in the passport.

Arriving in Thailand with the German passport, getting the Thai passport in Thailand and leaving Thailand with that passport is possible from a practical point of view as long as he will thereafter never again arrive in Thailand with a German passport.

Arriving in Thailand with the German passport, getting the Thai passport in Thailand and then leaving with the German passport is more advisable. When he enters on his next trip to Thailand with the Thai passport the immigration officer may question why he has no Thai departure stamp in that passport and at this point the situations with getting the passport in Thailand and leaving with the German passport can be explained.

Ideally, he should get his Thai passport in Germany. If there is not enough time for it before the upcoming trip, he can get it after his return to Germany.
