Hello,

Im an australian citizen and everytime i come to thailand i come on a non-imm cat "0" visa for reasons to visit family i have here.

recently (9 months ago) I started a net cafe here with my girlfriend (though i dont have any kind of work permit) the business is in her name and she runs the shop with my help. We are both young (im 23 shes 22) so we've had alot of help with family and friends putting this all together.

My problem is that my ticket is an open 1 year and it expires next month april 11th and my visa finishes the same month.

I dont want to leave and go back home, buy another ticket and get a visa "o" and come back to thailand only to stay for another year. Then do the same thing all over again. I got this business to run and i need to be here right now, so i cant afford to leave just yet.

what can i do to stay here. I want to stay as long as possible, forget the ticket i can always buy another one later when its the right time to go back home to oz.

Can i get an extension on my visa? Ive only got a month and a bit left on my ticket and visa right now.

(Ive been here since april 2008)

Any help would be very appreciated

If you do not want to return to Aus your best bet is a Double Entry Tourist Visa from Vientiene Laos. This would give a stay of almost 6 months with extensions and a border run in the middle/

Are you aware that you can do a border run the day before your Non O Visa expires and get another 30 days?

As for running a business and working without a Work Permit? You run the risk of Prison and deportation.

I called the department of immigration and asked about whether i could get an extension for reason to stay with family over here, they said that should be ok and gave me some details about what i need to do and all that. They also said that i could apply for a work visa if i wanted to work or could just get a tourist visa (like you've said)

I think i will try to apply for an extension with the reason for staying with family and have my mum help me with that. If that doesnt work out i'll just have to go back to oz and return later.

yeah the risk of working without a work permit, i know its silly to be doing what im doing, but theres nothing on paper saying that im working. Weve employed family friends to work for us so im never really in the shop and if i am its only to collect money or play a computer.

i really should get a work permit and the right visa, i'll have to get some info on the requirements and what i need to do. this forum has alot of useful information so i'll continue to read around!

It would be interesting to know what they told you as I do not think that you qualify for an extension. If you were married to your girlfriend that would be different.

Also there is no such thing as a Work Visa. A Visa gives you permision to enter the country but you need a Work Permit to work. You can apply for a Work Permit while on a Non O Visa.

It would be interesting to know what they told you as I do not think that you qualify for an extension. If you were married to your girlfriend that would be different.

Also there is no such thing as a Work Visa. A Visa gives you permision to enter the country but you need a Work Permit to work. You can apply for a Work Permit while on a Non O Visa.

They told me that i need my mothers thai ID, her home registration and a document showing that we are related e.g. my birth certificate. Said that if it was in english i would need to take it to my countries embassy and get it certified. Then she just discussed fees and where i need to go and what form to fill out.

I was told that i could apply for a different visa like cat "B" or something that is related to doing work/business in thailand and apply for a work permit. I was also told that if i was married i could get an extension though i would have to show that i make 40,000 a month or have 400,000 in a bank acc under my name, which would need to have been there 2 months prior to applying.

She said that the easiest thing would be to get a tourist visa from abroad and then enter and re-enter until it expires but then applying for a new one I would probably be asked questions about it.

That sounds alright but i believe it is limited to 60 or 90 days, you said that i can get an extra 30 days if i leave and re-enter thailand before the expiry date on my visa, so after the 30 i would need to leave again and get a tourist visa? then after another 30 days leave and re-enter again and get another 30 days and do this how many times? whats the total amount of time possible on a tourist visa??

So im getting a bit anxious now, it seems very difficult to stay in thailand. I think that if i dont get granted an extension i will have to go back to oz then apply for a new non-imm cat "0" visa. Last time it took about 3 days to do that, so i'll just have to book a plane ticket prior and hopefully only stay in oz for a week or two before coming back to thailand.

You never said that your Mother was Thai in your original post. Thay must be refering to 2.23 of this Police Order.

Yeah i think i will try to do the 12 month extension, doesnt sound too hard to do. It would be alot cheaper and easier than doing the tourist visa thing.

Ive never applied for an extension because i just never needed one so im a little worried that i wont be granted an extension. In the end its up to the immigration officer so hopefully it works out, if not i'll have to go back to oz and get a new visa at the thai consulate, the people in oz are both polite and helpful so i should have no problems back home.

Either way i'll work it out, THANKS alot for your input/comments and thanks again for the pdf file. I guess i will report back when ive worked things out.

If you do go for the extension. Once successful you have to report your address to Immigration every 90 days. They do not always tell you this.

Am I missing something?

If the OP's mother is Thai, and the birth certificate shows that, can't he apply for a Thai passport and avoid the hassles of visas?

Yes, I know about the problem that would cause with conscription.

To get a passport abroad, he wouldn't have to be on a house registration, which I believe is where consription info comes from.
