Dear Forum

My question is a simple one I think. My wife is in the uk on a 2 year settlement visa march08 - marck 2010.

I think she is allowed to travel outside the uk for 90 days per year with out affecting her status in the UK.

Would that be 90 days in each calander year OR 90 days in year1(march08 -09) and 90 in year2 (march09 -2010)

I have tried to find this info on the gov sites but I find them a total nightmare to navigate.

Hi there yorkieb i think you will find it is 180 days in the 2 years ,No more than 90 days in the one year prior to making the application of ILR. but im not to sure my wife was out of uk for about 80 days in 2 years.

did not want to push our luck with the home office.

i think you will find the 90 day a year is only if your wife is then going to apply for a UK passport, there is no law which states the max amount of time one can spend out of the UK whilst on FLR / settlement visa.the problem i ran in to was we were together spending too long out side the UK ,and they said we had insufficient evidence to prove our marriage was continuing whilst we were out the UK, ie, no gas or elect bills from Thailand !!

There is no maximum time allowed out of the UK whilst qualifying for ILR. But you do need to prove that you are living together in the UK, with the UK as your main residence. Difficulties can arise, as Micky44 found out, if you spend large amounts of time out of the UK.

For citizenship, it is no more than 270 days in the last three years counting back from the date of the application, with no more than 90 days in the final year.
