I am writing to ask for some advice.

I was renting an Condo in a ****** building (40K Per Month) and renting directly from the building owner. I had a two year lease, and only lived there for 7 months. I had informed the owner I was moving out at the first of the month and leaving on the 26th, so it was less than a month notice.

I had paid a 2 month deposit, and paid 10,000 THB for some "good will" for the rent for May.

The guy is very gay, and sensative. Told me he wanted a full months rent for May and I just moved out before the 26th of May. So I lost 2 months deposit and paid him 10,000 THB in the beginning of the month.

The day I moved, he called the moving company to say I owed him money and to return my things to his condo. The moving company called me to notify me of his call, but said he was asking something unheard of.

Lastly my Girlfriend's car was parked in the building, and the day I moved the security guards said she could not take her car out.

So we called the police, and they said the building had no right to keep her car as she had no involvment in the apartment at all. The contract was only in my name.

There was no damage to the apartment, I paid all utilies bills and lost 2 months deposit and still paid 10K for May's rent while it was not the total when I moved out. But I knew I would loose the deposit so I just paid a portion of the rent.

***** when they blocked my GF's car even the police said this was illegal.

Is there any suggestion on if I can at least fight back, as the guy is absolutely crazy.

If you've already moved out then I don't think you can do anything.

If you are still in the apartment and you are sure you are not going to get your deposit back then the options are as endless as your imagination.

Whenever I move into a new place, I write off any deposit that I give. If I do get anything back then I consider it to be a bonus.

Probably not helpful now, but something to bear in mind for the future as they are rarely willing to return any money.

I think this is generally true.

If you have paid a deposit of more than a month's rent, you may consider ceasing to pay rent a little early, but still allow an amount equivalent to a month's rent to be kept by the owner

I agree I broke the lease, but I gave the owner a 60 day notice and told him he could keep the deposit. The guy then told me :I will not let you move."

As I explained I did anyways, and he tried to stop me. I think many people will agree I did what was correct, gave him the deposit, gace him a portion of the rent and let him keep the 2 months deposit.

Now to hold a girl's car that had no relationship to the owner and myself was illegal. For a company like Sansiri to allow their building management do that simple amazes me.

In the contract there is nothing saying teh guy has any right to do that to my propoerty let alone someone who is not even on the lease. She just parked her car there.

I do not want the deposit back, I told the guy I dont want it. I want to fight back for the immaturity to break the law and have the building management be aware they are also in violation of the law

No landlord needs tenants like you. Ha ha, it's a buyer's market, he has every right to move if he wants. He's not some sort of slave to the landlord, it's a free world. What you should have done is stopped paying rent for the last two months, heh. But, according the contract, he does have every right to keep your deposit, unless you could find a tenant to take over your contract. If you did that, then he should give you your deposit back. Or, you could even take the deposit from the new tenant yourself and just keep the contract in your name, thought that's not ideal.

What is this, you need advice to rub someone who was nice enough o rent you his condo. You have to be kidding

Why do you feel the need for any revenge or retaliation.

Seems a 2 way thing.

You broke the terms of the lease, for whatever reason and that was a bad thing to do. Yet it does seem par for the course, being a landlord & having this happen but he got some cash from you.

He has been a bit of a <deleted> in return.

Seems fair all round, really. Let it go and move on with a smile.

Dear All,

My intention to write here was not to state a point, but as an expat ask some advice. As you know its difficult at times being in Thailand, and having things done to you that you know are wrong.

The facts are:

I gave 60 days notice I was moving, and forfieted my deposit.

I have every right by law to move, and I am not obligated to stay if I don't want too.

I never broke the law at anytime.

The owner and the building management

Held my girlfriends car at the building, and woudl not allow her to leave. She was not even on the lease.

I called the police, the police came and she was allowed to leave.

This was Illegal.

Why do I have to be nice to someone, who is not nice to me? Its a business to rent a condo, and things happen and people move on. The security deposit is to protect the owner in these situations, and I gladly accept he can have 80K, for moving out before the contract expired.

But why do we have to be "held captive" by some crazy guy, who told me "I am noty going to let you move."

Times are difficult, but its not my responsibiliy in the end.

I want to only state to the building management, which claims to be the best in Thailand that what they agreed to do was illegal. Why can't we as expats make a stand, do you think doing it the "Thai way" and let things be helps anyone?
