Hi ya all,

My wife and i want to bring her daughter over to live with us permantley in the Uk, She is 10 years old and we are both British passport holders. My wife will get the sole custody form etc etc, Was wondering if we can apply for "family member of an eea national" visa ( Or does the person who is applying for the visa have to be an eea national? ie my wifes daughter is Thai so she is not an eea national) Which is free or must we apply for "Child or dependant relative of a settled person" visa which is 33930 THB.

Also if we can apply for the eea family member visa, Is there any future advantage/disadvantage of doing this other than it's free? Any help would be appreciated

Cheers Mark....

To apply as a family member of an EEA national, said EEA national needs to be residing in an EEA state other than that of which they are a citizen. Therefore, I'm afraid that as are a British citizen living in the UK you cannot use the EEA route but need to apply for a UK visa for her.

See SET07 - Children

Unless you are also a national of another EEA state, in which case you can use that nationality to follow the EEA family permit route.
