Leaving The Country On An O Visa

My wife and I are currently living in Thailand on Non-Resident Retirement O visas. We need to go back to the USA next month. We plan to leave about October 15, and return to Thailand in about a month.

The problem is that the three month filing required on our visa comes up on October 27. Can we file early? Or do I have to wait until after the 27th to travel?

For the seasoning of the money in the bank there is no need that you yourself are also in the country, only the money must be there.

Don't forget your re-entry permit!

If it is about an extension of stay:

You should apply for the extension in advance, you can do that as early as 1 month before your current permission to stay expires. You are always advised to do it early, in case the want additional documents. The extension always starts from the day your current permission to stay ends, so you don't lose any days by applying early.

If there is need, such as travel plans, immigration often even extends before the last 30 days of your permision to stay.

Your post is not clear. Are you here on a visa entry or a one year extension of stay from Immigration? I suspect you are on extension of stay and talking about 90 reporting (TM.47) and that is not done if you are not in Thailand. A new 90 day period starts when you return. But you do need to obtain a re-entry permit prior to travel to keep one year stay alive.

Agree with the above but it is not really clear what your question is.

We do not really know what you have now.

Looking back at your posts it appears you have a 12 month extension of stay. Not a Visa.

If this is the case you need a Re Entry Permit from Immigration 1,000 Baht. Otherwise your extension will expire when you leave.

You appear to be asking about your 90 day address report. As said you do not need to report if you are not in the country for 90 days. The 90 day clock starts again when you return.

I am sure this has been answered hundreds of times but I am now a little more confused. Last March 17th I got an non-immigrant "O" visa in Thai Consulate in America. I am planing on getting Retirement extension when year is up. Anyway, in June this year I made a Cambodia visa run and was given a 90 day entry visa. Now I have just left Thailand and returned to America for a visit and plan to return end of month to Thailand. I was under the impression I could return same as before as my original 1 year "O" visa is still good until March of 2010. Now I am confused about this re-entry permit. Should I have gotten one when I left this time? I have not started the paper work for extension of stay. I didn't get an re-entry permit when I made the visa run to Cambodia so should I have gotten one to come to America?

You are fine. You have a multi entry non immigrant O visa and any entry receives a 90 day permitted to stay stamp. Only when you have extended your stay, or not have a valid visa, do you have to obtain a re-entry permit.

My apologies to all who responded about being unclear. I am currently on an Non-O retirement visa, which I obtained in May. I had an application to stay for one year approved on August 25, 2009, and I concurrently got a single re-entry permit valid through the same date. The notification of my place of residence is due on October 27, 2009, and I expect to leave the country for one month about October 6.

Based on what I have read in the comments here it appears that the best thing to do is to submit my notification before I leave. Does everybody agree on that?

You are on extension of stay. Your visa died a long time ago.

You will be leaving the country before your 90 day report is due. Your TM6 departure card will be kept by immigration and will tell them you have already left the country, and therefore no need to report. When you re-enter the country the 90 day clock starts again.

Yes, your 90 day report will have to be done 90 days after you return to Thailand. No need to do it now, as you will leave the country before you are here for 90 days. Each time you leave the country the 90 day clock is reset to day 1 when you return to Thailand.
