Hi.

I would like to know, on behalf of my boss, what it takes to obtain a visa type "Non-Immigrant O". He is married to a Thai lady since 12 years with marriage certificate and all, got two daughters with her, and has more than 800k Baht in Thai bank accounts (several accounts).

His current Non-B is finished (5th entry) in two weeks time and he needs to get a new visa on which he subsequently can also apply for a work permit as he just got the company registered and started the slow and expensive process of getting WP's sorted out. As the company officially only just started last month there is obviously no supporting paperwork yet (tax files etc) to obtain a non-B.

Appreciate any information on this subject.

Marriage certificate/copy, copy of wife ID card she signed, copy of her home register (blue book) and a short not from her asking for visa to be issued, along with the bank book showing funds available. Go to KL to obtain multi entry non immigrant O visa. Main items are marriage certificate/copy ID card and show of something in bank account but I would take it all. Should not be a problem obtaining.

Wouldn't it be possible to get an extension of his current stay (it does not matter if B or O visa) based on marriage if he meets the requirements?

This would be much easier and would have no effect on his WP application.

Hi.

Thank you both. "Meeting the requirements" is the big question mark - what exactly are those? Lots of information out there, most of which is either outdated, has ben changed multiple times or contradicting itself, i.e. total chaos.

Like some site stating you need photos of the house you live in, a floor plan of same, picture of you+wife+house, birth certificate of children etc etc etc a truckload of paper plus, and that shows up almost everywhere, "proof of income no less than 40k Baht/month". And specifically the latter does not exist (yet). Then other places state "either monthly income OR money in the bank" yet others state "monthly income AND money in the bank".

If it wasn't so confusing i wouldn't ask here......

Yes that would be an option if account in his name and above 400k for last two months. He could also obtain a 60 day extension to get it in order. Or he can obtain visa and use that as it seems he has used visas in the past. Was thinking after 12 years he would know about extensions of stay and for some reason wanted a visa; but perhaps he does not.

My post crossed with yours - the requirement is 40k income or 400k in bank account for 2 months (3 months for later extensions).

It is not really that difficult.

Yes, photos of family inside and outside home (incl. house number) and a map to home is required. NO floor plan required!

Money (min. 400K) has to be in bank account(s) in the applicant's name only. The money has to be in the bank for at least 2 months prior to the first application (3 months for subsequent applications).

And a list of documents he would certainly have or could easily obtain and most important is that the wife comes along to the Imm office.

Search for the latest pinned rules (police order No.777/2551 para. 2.18(6)) on this forum.

Hi.

Just found out that his bank accounts are all in joint names - him and his wife! So i guess that disqualifies him..? "Not really that difficult"... yeah, in some other places the marriage certificate alone would suffice (my home country included).

Not really difficult:

Have him open an account in his own name pronto and dump at least 400K in it. Then just before his current stay expires apply for a "visit Thai wife" extension which will give him 60 days (no finance required for that), but photos, map, and wife are required.

At the end of the 60 days the money has been seasoned long enough for a first time application and then file an application based on Thai wife.

Easy!

That is indeed the solution :)

For 60 day extension also need to take marriage certificate, wife's ID card and house book (tabian baan) plus copies of passport pages and TM6 card + passport photo. Fee 1900 baht.

And this way (extension based on marriage) has several advantages. Obviously 1 year extension in one go.

His new company does not qualify yet for him to get a 1 year extension based on hies employment (need between 1 and 2 years audited bookkeeping for that).

Plus he will never be in a situation where if he stops working would have to leave on the very same day, as would be the case when he has an extension based on the WP.

And if he declares a salary of 40,000 Baht, then next year he won't need the 400K Baht in the bank but can use his local Thai income to support his marriage extension...
