I am currently getting everything ready to apply for a Settlement Visa for my fiance )we marry in 3 weeks and will apply a week or two later.

I believe we hit all the silly criteria and and can prove what they require and got a Visiotrs visa earlier this year without any hicups, BUT I have a question when I look at the Settlement visa application form !!

Can someone on a settlement visa work in the UK ???

Question 8.6.7 is - Do you intend to work in the uk ? Yes or No (if yes supply details)

Whats the "correct" answer ?

In my case my wife really wants to get a job but I dont want to answer wrong - I worry answer yes and they start thinking is she married just so she can work in UK and answer No do they start thinking she wants to claim benefits !!

Can anyone help ?

Your wife can work after obtaining a national insurance number when she arrives, your wife just can not claim any recourse from the government in any shape or form

... we were same as you... visitor visa last year, she stayed 6 months; we ticked "yes" intend to work box which you are entitled to do with a settlement visa... my mrs had interview to get her settlement visa...they asked if she worked when she came as a visitor which she didnt of course.. and also asked what type of work she wanted to do once settled in england to which she replied "anything but i know is hard because everybody lose job in england"! ... which apparently mildly amused the interviewing ECO... if she wants to work just tick "yes" its not a problem

oops soz coyC2 my reply appears to have embedded in your original post! ... we appear not to have yet encountered any post UK arrival traumas... registered OK with doctor... got appointment next monday to open bank account...next week appointment in leeds for NI number interview and also registering at local college for ESOL with citizenship class (which you have to have to apply in 2 years for ILR unless you're taking the mastermind level 3 exam)... make sure the college you register with is ESOL accredited by an awarding body listed on the UKBA website or you wont qualify and will have peed your £825 up the wall..!

As she will be coming as a spouse then she can work, so she can tick 'Yes' and in 'supply details' simply say she will look for suitable work once in the UK, unless she already has a job offer, of course.

But for those reading this who are applying as fiancés, they cannot work until after the marriage and they have obtained FLR. However, I can see no harm in a fiancé visa applicant saying that they intend to look for work once they are legally able to do so.

BTW, one can start work before obtaining a NI number (the employer will use a temporary one until the real one comes through), but will obviously need to apply for one as soon as one does start work, if not before.

The temporary NI number is made up in the following way;

The first two letters are 'TN' (temporary number), the persons date of birth 'DD/MM/YY' (for the six numbers) and 'F or M' (for female or male) as the final letter.
