Already posted and received some very useful advice on this topic. Unfortunately though I still seem to be stuck between a rock and a hard place.

I understand my visa ends the day I resign from my work. I was told also that I will need to get a letter from my employer stating that I have resigned that I must take to immigration.

My question is, what happens if my employer refuses to give me that letter? For example, if they demand money from me before they give me the letter. I am afraid they might do this.

[brief history: without going into too many details, they breached their contract with me, which is why I am leaving. However, I've no doubt they won't accept this as a valid reason for leaving and will say I am the one breaching the contract.]

Where does that leave my visa status? And if I decide to just up and leave the country (either that same day or a few days later), will that make things difficult for me at the border when I am trying to depart (for example will they demand to see proof that I have resigned/returned my work permit at the border)? Or does it only make things difficult if I then try to re-enter?

I am trying my best to do the right thing and leave my job/Thailand on good terms, but it isn't as easy as I'd hoped. Thanks for any advice anyone can offer.

Do you have a Visa or an Extension of Stay?

Just looked back at you do have an Extension of Stay.

Not an expert but personally I would just leave on the same day and visit a Thai Consulate and get another Visa. Then return. When you leave your permission to stay will expire.

A visit to Immigration is only going to get you 7 days anyway at a cost of 1,900 Baht.

Sounds like you need a rest why not go sick? Just phone in and say you are sick and have your few weeks off to do your thing then leave. If as you say they have fallen down on there contract why should you worry about them?

They should provide you with a letter by law. But that does not mean they may be difficult. You should leave the country on the day you hand in your notice to keep immigration record ‘clean’.

Do you have re-entry permit? If no, then your extension of stay will die on leaving the country. Re-enter the country on visa exempt entry (or tourist visa). If yes, you should obtain a tourist visa and re-enter using that. That will give you new permission to stay date and will cancel previous permission to stay/re-entry permit date. (If you try entering on visa exempt entry the immigration officer may stamp you in for the rest of your permission to stay under the re-entry permit, rather than giving you new 30 day entry). Put the tourist visa number in the ‘visa number’ box on arrival card Form TM6.

In my opinion you should be OK if you leave on the day or next day after you resign without a re-entry permit.

This will invalidate your current permit to stay and satisfy Immigration and you can come back with any kind of new visa or visa exempt stamp without problem.

Your employer may notify immigration immediately so don't wait a "couple of days".

Thanks for the quick responses.

Notifying them of my resignation the same day I am leaving the country will be the best option I think. Would've preferred to give them more notice but it seems these things are set up to end badly. They kinda paint you into a corner by forcing you to leave immediately. Oh well.

Hope things go smoothly for you. Unfortunately that is the downside of being on extension of stay. If you were on Non-B (or Non-O visa) you could remain here until permission to stay expired (but you would have to do the 90 day border runs).
