2 Phase Help Question

I have 2 simple questions that I could use some help with.

My girlfriend in BKK can speak some english but cannot read it very well, so i was wondering if there were any of you out there that could write in Thai so she could be able to understand answers to some questions regarding a USA visit visa and the subsequent requirements.

I fly back to the states tomorrow and thought I could possibly get some help here.

Also, does anyone know the requirements ond both ends (hers and Mine) that we need to go through to obtain a visa for her, and I know this has been gone over here before many times, and i appologize for asking a redundant question.

Any help would, be greatly appreciated.

The US Embassy have staff who can speak Thai as well as English, so I dont think language is going to be a problem. Have yr gf do a search in Thai on one of the other Thai webboards as there will be thousands of users who have had visa experience and who will have commented at length in her own language.

What type of visa are you looking to get her? From the brief bit of information you provided I think a tourist visa may be an uphill battle (if not, then an effort in futility). In tourist and student visa matters there is a presumption under section 214b of the Immigration and Nationality Act that must be overcome in order for the Consular officer to grant approval to a non-immigrant visa application. The law basically presumes that she is an intending immigrant unless she can provide proof contradicting this notion. Basically, she must show strong ties to Thailand (or any other country) and weak ties to the USA. The presence of an American boyfriend would make tourist visa issuance very difficult as it shows strong ties to the US and weakens the ties to Thailand.

If she has any of the following, it may help show strong ties to Thailand.

a well paid salaried job

Strong Social commitments

Family ties

a business

or property that needs maintenance

If there is a possibility that the two of you will marry and apply for permanent residence, then I strongly suggest you look at options other than the tourist visa. Using a tourist visa with undisclosed immigrant intent could be construed as immigration fraud as this category is strictly non-immigrant.

A K1 visa is a good visa for unmarried couples and the fastest of all the family based categories. Since you have just left, you would meet the physical meeting requirement. The only major downside to the K1 visa is the fact that it is more expensive and more time consuming to obtain. On the plus side, it has a much higher rate of approval than tourist visas for those in your position.
