April 9, 200521 yr If I come over on a Non-Imm-O Marriage visa is it OK for me to work via telecommuting over the internet to my current job/company overseas? My job has nothing to do with Thailand and I am not taking a job from a Thai etc. Do I still need a work permit? Thanks, I appreciate any help -nam
April 10, 200521 yr In practical terms it is probably ok as there does not seem to be any work permit provision for this type of occupation yet and there seem to be others doing so. I would keep it low key and when/if work permit becomes available look into getting it. Of course that assumes your company is ok with it.
April 10, 200521 yr Technically the answer is YES. Any job, even unpaid needs a work permit. However if your work is entirely on the net and you keep you head down and don't advertise or talk about what you do, then I do not see that will have a problem. You will need to make sure that meet the 400 K requirement for your visa extension each year. Other than that just tell people you are living off investments overseas, or savings..........
April 11, 200521 yr Author Thanks Guys, I also found this thread at the Immigration website, someone asking the same question. http://www.thaiimmigration.com/inv/index.php?showtopic=46 ""In your specific case you are not doing anything wrong. Your income comes from abroad and you got a Non-Immigrant “O”. Perfect, just according to the book."" So it sounds like they are OK with it. best regards nam
April 11, 200521 yr I am sorry but you cannot trust that ThaiImmigration site. Just look at what he says........ "The definition of work according to Thai Law:“WORK means, to engage in work by exerting physical energy, or using knowledge, whether or not in consideration of wages, or other benefits”. Given that, how can he say what you are doing is within the law? You are "using knowledge" so you are working!! However as stated, keep your head down and you mouth shut and you should be fine.
