Hi, I have posted something about this before but still worried and looking for a headway. I have been in the UK for 4years illegally(illegal entry/deception). Not known to the authority at all, have a Gf and a 4 month old Son, who are both British Citizen.

Seriously looking for a way to bring myself out of this situation, I have spoken to a solicitor who advised that I need to return to my home country and apply for an entry clearance on the basis of continous contact with my son(ACCESS RIGHT TO A CHILD LIVING IN THE UK). We considered getting married but my Gf is not up to 21years, so a spouse application is not possible and marriage in the UK will require a COA.

I have studied all the details of the application on the HO website and going through the Immgr. rules and legislations but they dont always work like that, cos I know it sometimes depends on the ECO's discretion. We have concluded on the ACCESS RIGHT APPLICATION and already compiling all the necesary documents.

A visit to the IAS(Immgr. Advisory Service) gave me an idea of what to expect, though the application is within the rule and my previous breaches should not normally count in such category, the adviser warned, that there will be prejudice against me and my application from the ECO. On a second thought, I am considering other alternatives to returning home but not very sure of what to do at this point. I need alternative ideas or advise on the current one.

I will appreciate every bit of advise from members and any constructive criticism will also be appreciated but honest and genuine advice please.

Although Para 320(7C) of the immigration rules doesn't apply when the applicant is applying as a person exercising rights of access to a child under Para 246; Para 320(11) does.

So you could still be refused depending upon the circumstances of your illegal entry and stay and what you were doing during that 4 years, for example illegall working.

I think that you really need professional advice.

Your reply is very funny. Its really funny to see such a response in todays world of globalisation. Are non thais not allowed to seek and receive or give advice from thais? get real!!! man
