Hello to all,

I’m looking for some advice on the best way forward.

Myself – Mid 30’s male, UK passport holder, currently working Australia.

Frequent visitor to Thailand (toured the whole country) over the passed 10 yrs for various lengths of time, longest being 8mths on a non immigrant type ‘B’. Been with the GF for 18mths. I speak some Thai but I’m still learning. I have a reasonable understanding on how things work and have studied the culture.

The Gf – Late 20’s Thai passport holder, currently living in Australia. From Kalasin area, speaks English but again still learning. She is currently pregnant with our first and has a son from a previous relationship (Thai) he took off a long time ago.

Her family (I have met on numerous occasions) are hard working and on the face of it appear to be decent people, they have never ask for anything from me and I believe are happy if the daughter is happy, the cynical would say they are happy because they don’t need to support her and I’m sure there is an element of truth in that.

GF has been diagnosed with SLE lupus disease (a bit like sever arthritis) which puts limitations on what she can and can not do i.e. work for long periods of time.

I have an option of working 6 mths of the year in Australia or UK and we would like to spend the other 6 mths in Thailand. I have done the maths and even worst case we would be ok and still be comfortable.

Now the question is what is the best way for us i.e. can I get a Humanity Residency? No problem with proving her and son’s dependency on me or gaining letters from doctors Thai/Australian with ref to her condition. I would prefer to do everything by the book but do understand short cuts are used.

OR

Am I totally barking up the wrong tree, should I just do the norm and do visa runs etc?

If you are married (with paper) you could get a marriage visa. I understand about 400000 baht in the bank in thailand and a lot of paperwork.

You could also get a non O based on suport ofchild.

You may have a lot more trouble with her staying in Australia unless she has residency allready.

Marrying your Girlfriend would give you more options.

You could then get 12 monthly extensions. 400,000 Baht in a Thai bank OR a monthly income of 40,000 Baht.

If not apply for Non Imm Visa and do border runs every 90 days.

When the child is born, he/she also would give you the same visa options and extensions in Thailand as if when married. But make sure you legitimise the child when born, since you are currently not married. By legitimising the child you claim the child as your and you would become the legal father. procedures differ, depending on the country where the child is born.

For now a note from your GF asking for a visa for you with a copy of her ID should give you a multiple non-O based on visiting friends from the consulate in Perth.

No problem with her entering Australia, she has a sub class 457.

Intention is the child will be born in Australia, this I believe gives us more options in the future Child with Oz passport, child with Thai passport myself with uk passport.

You should be able to obtain yearly non immigrant O visa in Perth and probably Brisbane to cover your stays in Thailand (one border trip for second 3 months). This would not require marriage under current policy.

That will a good first step.

Then marriage, which will allow you to extend the visa and stay in LOS without border runs,

provided you can show the required income.
