Condo Regs.

Hello All,

Just thought I'd ask the question.

Can a condo developer just leave running our condo high and dry?

I haven't got the regulations to hand, anyone know?

I thought it was a 10 year term unless voted out by the residents?

Can they just go and switch off the lights in the office downstairs?

This is Thailand. If any Thai sees no benefit to do anything, they just leave. No explanation, no warning, etc. Just go and disappear.

I would get together with other tenants, if they cooperate and get a lawyer and hit tem hard for financial damages.

Never heard to 10 year term. I think just wishful thinking on your behalf.

You did not say whether there is a Committee in place or exactly what position the developers resigned from. There are three separates post that might be relevent.

Committee - Any committee member can resign at any time. If a resignation leave the size of the Committee below the minimum specified in the Condo Act (at least 3 members), a general meeting must be hold to appoint replacements. Otherwise replacement can be elected at the next AGM.

Justisic Manager - Can resign at any time. If there is a vacancy then the Committee must appoint one of its members to act on an interim basis and a general meeting to appoint a perminent replacemwnt must be held within 60 days.

Building Manager/Management Company - Notice period will be specified in the contract if one exists. Our contract have always allowed for termination by either side with one month's notice. Generally the Committee can appoint a replacement without the need for a general meeting.

We have just had our first meeting since the condo was built 3 years ago.

Looks like we will be getting our own management company in to do the job.

The question is where is our sinking fund and monthly maintenance money?

The developer is a falang and the current juristic manager is Thai.

I feel we will be taking the suspects to court.

Good luck with the law suit. It will be hard to prove. Be prepared to raise your maintenance fees significantly to raise a new reserve fund.
