I think we can do this legally. You get a tourist visa to America and we have our BIG DAY at the Temple hehe. You can stay until your visa runs out which is 60 days (extend 30 days if you want to stay longer).... I will get a tourist visa for Thailand as well and I fly back to Thailand with you. Once in Thailand I will have 60 day visa... then I pay a little more and extend it for 30 days. Every month we can keep extending the 30 day visa until we can buy the 1 year marriage visa. maximum stay of 90 consecutive days (ie two renewals) on a tourist visa, after which you have to leave the kingdom. This can be resolved by applying for a 60 day tourist visa at a neighboring consulate, and starting over. Furthermore, those leaving and re-entering Thailand on the same day are usually asked to show proof of at least 10,000 baht (300 dollars no problem) in a our bank account or cash.............. Find out if this is legal. I think it is and hope it will work. The only problem with the tourist visa is that I cannot work in Thailand. Maybe I can do small jobs like fix computers or do work for the church. This is the fastest way I know and we wont need the 400,000 baht yet. I will bring 3,500 - 4,000 dollars (120,000 baht) with me to Thailand in August. I should also be getting a nice income from America. I will do American Jobs on the internet. I will design websites and sell them on internet. I know I will find a way to get income from America. I need this also for k-1 Marriage visa 1 year. I need to make 1,000 dollars (33,000 baht) monthly income from America. I know I can get that easy with internet jobs. Ask your friend if this is legal to get married and live like this in Thailand until we get K-1 marriage visa. Love you lots Thirakkkk!!! I'm learning a lot about travel. All long term visas require a Non-Immigrant visa in your passport. Non-Immigrant Visas are obtainable from the Thai Embassy in your country for the purpose of investment, visiting family, and a job at a company in Thailand. It seems that the Thai Embassy will not issue them if you have not been to Thailand before so you should get a "Tourist Visa" for your first visit which allows you 60 days and can be extended another 30 days at any Immigration Office. If any of the following listed items are done while you are in Thailand, then the Immigration Office in Bangkok can change your visa to a Non-Immigrant Visa which can then be extended for indefinite 1 year periods. This is the way most all foreigners live in Thailand although I have met several who go to the boarder every 30 days to get their passport stamped. Too much of a headache for most people, but that is legal and I have heard of one person living here for 17 years so far that way. (that is what I ment to say lol rakkkk naaaa)

I have to visit thailand once to even get the 1 year visa soooo I will get the tourist visa and keep renewing until we can get the 1 year k-1 visa. Love you so much Pennapha! Can't wait to see you in Rome. :-D I think this will work my love! Reply:

okay I was wondering if we can do this. Just keep renewing the Tourist Visa when Im in Thailand until we can afford the k-1 marriage visa. This is the Plan and we need to know if tourist visa will work. She will graduate in college in rome, italy. She will then fly back to Thailand in May or June. She will apply for the Tourist Visa and fly to America near the end of July. We will get married in Utah at the temple. She will stay for about 60-90 days until her return date. I will also have a Tourist visa and I will fly back to Thailand with her. We will probably live with her parents for awhile or even rent an apartment in Chaing Mai. I will keep extending my visa every 30 days so I can live in Thailand. My question is.... is this legal? We will work on the k-1 marraige visa when I am there. I will be getting an income from America and will do web design and graphic design work on the internet. I will also start my internet asia importing business online. I can do lots of work from all over the world. It would be nice to be able to work in Thailand but you can't with the tourist visa. Thanks everyone!!!

Are you talking about a visa for the USA? In Thailand it's normally a Non O visa that you'd extend to stay based on marriage.

1) Kamakashi, re-confirm "until we get K1 (1yr visa): the above commenter is correct;

this is a US fiance'e visa to bring your partner to US and get married within a 3 month window in the US. Upon accomplishing

your marriage/reception, then you file for a CR or conditional residence card (temporary green card), this process will take

you maybe at least 9 month. (providing your partner meets the requirement/criteria for this visa)

I think a more logical way is for you to go to Thailand, get married and file your marriage in Thailand and then with all the

documents, then file your petition to bring your partner back to the US either on a tourist visa or a K3 immigrant visa.

I think you should consult an US immigration atty. or specialist in US immigration law.

You cannot get a K1 visa if you are already married. It's a fiancee visa ONLY.

K3 is for married people, but few people do that one anymore. Most now go the CR1 route, because it's just as quick these days.

Going to the US on a tourist visa and getting married is illegal, she needs to apply for a K1 if you are not married already or a K3 if you are already married.

Also getting a tourist visa is going to take 2-3 months possibly longer. Also if you want to get a K1 visa you are going to need to make more than $1000 per month. You need to be 25% above poverty level which I believe now you will need to make around $18,000 USD. Getting a Thai to the US is not easy and not quick.

I would suggest you either stay in the USA and get a good paying job to make enough for the K1 / K3 visa and then either come to Thailand and get married and apply for a K3 or just stay in the USA and apply for a K1, either way a K1 or K3 is going to take between 8-12 months. When we did the K1 and it took us 10 months.

thanks everyone. Yes we want to get married in America. Then I will move to Thailand and live there. Does she really need to get a k-1 even though she is not going to live in America?? She will not be staying when she comes. We would get married and then she would fly back to Thailand and wait for me. We will save our money to get the immagration 0 visa and work permit so I can live in Thailand.

Okay... so me and my fiance have to make 1000 dollars a month (33,000 baht). She will need 400,000 baht in bank to apply for k-1 fiance visa. She will then fly to America to get married. She will stay for about 60 days or more.... We will share the bank and I will apply for the Immagration 0 visa and work permit for Thailand (maybe get work permit). The lady at the post office said that it will take 4-5 months to get the visa's. So all we need to do is get the 400,000 baht in our bank.

I am making 1,100 a month right now at my job. All we need to do is borrow 400,000 baht. She applys for k-1 fiance visa. Flys to America and we get married in the Temple. I apply for the immagration 0 visa and fly back to Thailand with her and we live in Thailand together. We will give back the 400,000 baht and I will work hard to get 400,000 baht again while we live in Utah until I can apply for immagration 0 visa.

I am making 1,100 a month right now at my job. All we need to do is borrow 400,000 baht. She applys for k-1 fiance visa. Flys to America and we get married in the Temple. My other option is getting a immagration o visa and move to thailand and marry her. But I heard that I need to visit Thailand at least once in order for me to apply for the immagration 0 visa. Then we will fly to America and get married and fly back to Thailand........ my other question is..

If the US marriage is not a religious requirement of your faith the logical thing to do would be to get married in Thailand. You fill out a single page form at the US Embassy listing your bio data and two references in the US and have it translated into Thai and registered with the Ministry of Foreign Affairs and register the marriage at any District Office. Can be done in a day or two. legal in all countries. Religious events optional but legal marriage is the signing of marriage paper for file in District Office. No special visa requirements.

To obtain non immigrant O visa would require 100k in Thai bank account if issued in Kuala Lumpur.

Extension of stay for one year would require the normal 400k in your name for 2 months or 40k income.

you say that I don't need a visa to sign marraige papers. Does that mean I can live in Thailand and wait for my immagration O visa??

Where is it that you want to live?

If the US, come here, get married, go back to the US without your wife and apply at US Immigration for a visa for her. You will not be able to apply in Bangkok.

Or, apply for a fiance visa, wait the wait, take her to the US and get married.

You do not need an O visa to do either of those things.

If you want to live in Thailand, come here, get married, go out of the country to Laos or Malaysia and get an O visa. It takes two days. Apply one day, pick the visa up the following day.

(If you plan on living here, what do you plan to do to support your family?)

There are details with each option, but I won't go into them because it appears they confuse you.

Again, I suggest you look at the pinned topics at the beginning of the forum.

When you're closer to knowing what you want to do, someone can give details.

Actually, it's not illegal if she has no immigration intent. If she comes over and gets married then returns, that's fine. I might not mention the marriage to immigration in that case.

OK, I just read a page of posts, and I hope that you are taking the suggestions given to you OP. I am a US citizen who was married in Thailand almost 3 years ago. yes, a tourist visa is the fastest way to get your (soon to be) wife to the US taking into account that you are ALREADY MARRIED.

A tourist visa is more difficult to get than you think especially to the US. Do some research here and you will see. "Girlfriends" of falangs get turned down more times than not, regardless of 'status" however every case is different, just keep in mind that obtaining a tourist visa to the US is a "crap shoot". Already being married and showing consistency is what the embassy (your government) wants to see.

My wife was approved for a 10 year tourist visa recently, but we had been legally married for over 2 years and have a child together. I am also legally employed in Thailand and have been for 3 years and this is what the US government is looking at (consistency).

I am not trying to preach, but I really hope that you are looking at the WHOLE picture. Coming here and thinking that you are going to make money "on the side' by fixing computers probably will not happen, since getting a computer fixed here is very cheap to begin with, so the Thais already have that covered. Stating that it is easy to make $1,000 dollars on line, i am wondering what you are basing this on? You make a little over a grand a month now working at Wall Mart, so if pulling a grand from some online business is so easy then i am sure you would be doing it now, and you would not have any financial worry.

Thailand may be 'cheap", but at the same time if you have very little financial resources, your baht will be pissed away in no time, so again do more research and good luck to you and your future misses.

Thank you Mizzi39.... Yes I am working with 3 business right now and I am getting an income from them. One of them is my uncle and he plans to pay me 10 dollars an hour. I will work with him on the internet. I am also starting my own importing business since that is my dream. I will go to Singapore and get this going. I have already begun to get an income from these companies while i live in Thailand. I will also be selling two products in Thailand. The companies cant wait for me to start selling them and I know they will sell very well in Thailand. This is what we are going to do. She has a bachelors degree in Tourism and will work for the Thailand Airlines. I will also design for her get her company growing. She already makes more than I do. I will fly to Rome and propose to her. In July or August she will fly to America with a Tourist Visa and we will get married. Once her days have expired in America she will fly back to Thailand. She can get a Tourist visa really easily from the Rome embassy. She is also studying Tourism and the school can get her the visa faster. When she is in Thailand we will save up our money until I can fly to Thailand and live with her. Thank you everyone for your posts. It has helped me learn a lot and make plans.

You appear to have an issue that requires you be married at a temple in Utah? There is no option to marry in Thailand for you (to meet church requirements)? If you marry in Thailand you can not marry again in the US as you are already married, as is she, under US law.

The only legal way to do what you want is to apply for a fiancee visa and you should remain working in the US during the wait and not have to worry about any visas for yourself. After you marry in the US a non immigrant O visa will be available at any Consulate (single entry) and once in Thailand you can either extend (if you can meet the requirements) or travel to KL or other consulates for a non immigrant O visa. These 90 day entries can be extended for 60 days inside Thailand for 1,900 baht.

Your OP seems to indicate you planned to live in Thailand - other posts speak of K-1 visa. If you do not plan to live in Thailand why all this concern for a few months wait for visa? She can do the wait for fiancee visa with or without you and go to US/get married/get green card/live married life with you. If you want to be here in Thailand during the wait, or part of the wait; and don't need the income, you can use tourist visas.

she will get tourism visa... we get married in the temple. She flies back to Thailand. I work on getting visa to live in Thailand. I have jobs lined up to support me and her in Thailand. She will be making a lot of money in Tourism anyways.

okay I bet you are all wondering what I mean by Temple Marriage. You will sign marriage papers first before you get married in the temple. You must be married first before you go thought the temple. Here in Utah you can do both at the same time since a temple marriage is considered a civil marriage. We will get married and then I will work hard and start my businesses and live in Thailand with her.

All I need to do is see her in Rome and meet my fiance. She is studying tourism at the college in Rome. I will bring marriage papers with me and we will sign them. We will then be legally married... We don't even need a visa to be legally married. She will then fly to America on a tourism visa and we will go through the LDS Mormon Temple. She will then fly back to Thailand and she will wait for me to move there. She will come here to visit my family and friends in July or August. I will have enough money and my businesses started by then to apply for Visa to live in Thailand. I will be designing for these companies and doing web design online. I will be graduating college soon in Graphic/ Web design. The college is looking for a job for me in Thailand. This also could get me to Thailand faster since I would have a job lined up for me. I will go on vacation for 3 months in Thailand while I wait for the visa to live there. My dream has always been to live in Asia. i can't wait to start my company. I have been preparing myself for this.

If you are not working for a Thai company with a work permit you are taking a risk - and for a new marriage/young person I would be very careful if everything is not on the up and up. As for her income is she from a family that will be providing the source for this "lot of money"? A don't believe most recent grads are making a lot of money in the tourist industry at present. But that is your call and wish you the best.

You are also talking entry of GF into the US as a tourist when the plan is marriage. She is likely to be asked about that and if she lies that also could come back on her.

This is very good advice and i hope that you (OP) takes notice. The last thing that you want is to be caught working illegally. Having your hands in so many "cookie jars" increases your risk of being caught.

As far as your girlfriend is concerned, being educated overseas definitely has its advantages, but entry level employment here in Thailand does not pay that much, regardless of where she graduates from.

If you have products to sell in Thailand, and your dream is to open up an import/export business, it may be best to get this business up and running before even stepping foot in Thailand, along with the proper documentation that you will need to operate legally here. It is important to keep in mind that to run a business in Thailand (legally) as a foreigner costs lots of money. There is a lot of information out there on how to do this, so arm yourself first.

Keep in mind that working without a WP is illegal, and you sure cannot work on a tourist visa legally. Even if you decide to get an "O" visa you will still need to be working or backed by a company who has the burden of producing the paperwork to immigration just to get you a WP, since the WP is granted after your employed and not before.

You stated that it will be easier for her to get a US tourist visa from Rome? It will not, unless she is Italian. I assume that she is on some ED visa in Rome. She is Thai, and trying to get a visa to the US, will be no different than if she went to the US embassy in Bangkok. No offense to you and your girlfriend, but you should really stop and take a few paces back and really evaluate your situation before moving forward, because what we are reading here shows that you do not have all of your "ducks in a row". If not.... then we will get married in America which is legal since she is not staying in America. Then I fly back to America on April 7th. Right now she is applying for a Tourism Visa to America. She will get her tourist visa in 3-4 months (may have to rush the tourist visa) . She graduates college in Rome in may or June. Then She will fly back to Thailand to be with her family. In July she will fly to America so she can see me and my family and friends. She should have the tourist visa by then. She will stay for about 2-3 months. I will not start a business in Thailand!!! Remember,she is applying for a tourist visa with noooo guarantee that it will be approved. Being married for one month and applying for a tourist visa without you having any consistent ties to her prior will be a "crap shoot" at best.

3-4 months for a tourist visa? My wife had her tourist visa in hand 3-4 days after her approval. her interview took 3-4 minutes, and her appointment took a week from the time the application was submitted. You say that she is applying now? The application takes all but 30 minutes to fill out.

blehhhh... You guys are confusing me. You keep saying its legal and not legal to get married. One says you need a visa to get married... the other says no you don't need a visa. She will fly to Utah with a tourist visa. We will get married and she will fly back to Thailand and wait for me. Isn't that legal??? I will then work hard to get myself ready to move to Thailand. I will talk with the US Embassy monday and give them the full story. I will post on this wall exactly what I need to do. Thanks for everyones help! and...... what does OP mean? lol
