Hi all, please can someone clarify the following for me,

My TW has a friend in the same town..she has told me this...

Her friend came last year on a fiance visa to UK

she since married her UK husband in the UK

she has now told my friend her husband has applied for a settlement visa here in the UK?

I thought you could only apply for a settlement visa for the UK FROM Thailand?

I keep telling my wife that her friend isnt giving her the correct info, hope im right lol

Yes you can apply for the 2 year FLR settlement Visa in the UK If the person came to the UK with fiance visa and married.

Much easier, In effect you have already got a settlement Visa by obtaining the Fiance Visa.

Well you were nearly right - fiance visa is the only one that doesnt require you to leave and apply from overseas - for obvious reasons!

There are various types of settlement visa, all of which allow entry for a set amount of time after which one has to apply, in the UK, to extend one's leave; either for a set period (Further Leave to Remain) or indefinitely (Indefinite Leave to Remain). If one does not do this then one has to leave the UK or be there illegally.

Most are usually valid for 27 months; but a fiance visa is valid for only 6 months during which period one must marry one's sponsor and then apply for FLR. See Fiance(e)s and proposed civil partners.

It is possible to apply for settlement in the UK if already in the UK on a non settlement visa; provided that one's current leave to enter has a validity of more than 6 months. Other categories can apply in the UK, too. See How to apply for settlement in the UK.

A fiance visa IS the settlement visa, valid for six months during which time you must marry in the UK. once married you don't apply for another settlement visa in the UK but for FLR (further leave to remain in the UK).

As 7by7 says it is possible to apply for settlement in the UK (after getting married in the UK) if you are already in the UK on a non settlement visa (eg; a student visa or work permit) provided that one's current leave to enter has a validity of more than 6 months, although, I believe the minimum six month validity period has been challenged in the courts and at the moment immigration are allowing current marriage applications even if there is less than six months left on their current visa.
