Uk Settlement Visa Refusal

Featured Replies

If a Thai applicant is refused a UK settlement visa, what is the process for appealing, presuming that one can satisfactorily address the reasons given for the visa refusal ?

If someone could give an indication of the process, the time it takes and the costs, I would be most grateful. Thanks.

The appeal process is clearly laid out on the UK gov't visa page, look on the left-side bar for FAQ.

Thanks for that, much appreciated.

In terms of the practicality, is this usually just a submission of your appeal and the grounds under which you make the submission or are people usually represented ? As it seems to to be in London, do people usually attend in person, do they usually appoint lawyers, would any of this be covered by legal aid or do they just send the forms in and wait ?

I doubt that you would qualify for legal aid on an issue such as this.

See the FAQ's from the First-tier Tribunal (Immigration and Asylum Chamber) especially 5. Refused entry to the UK (out of country appeals).

There is no fee for lodging an appeal. However, should it go all the way to a hearing then I would strongly recommend that you instruct a professional representative; either a specialist immigration solicitor or suitably qualified OISC adviser. As IsaanAndy says, it is unlikely that you would get legal aid.

However, you haven't even submitted the application yet. Get that right and there will be no need for an appeal.

You have not submitted yet and you want to know about appeals ??

Why not ? Only the foolish do not look beyond their immediate horizons.

Your thoughts are as mine, get it right and we won't need to cross that bridge. However, one back up position is to re submit at additional cost and another is to appeal. If the appeal is technical then knowing something about the likely costs is useful.
